JAKARTA - Wijaya 80 took firm steps to fight for the integrity of their work which was allegedly commercialized unilaterally by one of the State-Owned Enterprises (BUMN), Pertamina Patra Niaga.

The group, which is led by Ardhito Pramono, Hezky Joe, and Erikson Jayanto, also reported an alleged copyright infringement on their hit song, "Last Time", to the office of the Directorate General of Intellectual Property (DJKI) in Kuningan, South Jakarta on Wednesday, December 17.

This complaint report was submitted after the song was used without permission in the promotional material of the MyPertamina application on various official social media platforms of the company.

Wijaya 80's lawyer, Andhika Jemat, emphasized that this issue is not just an administrative matter, but concerns the rights of his client.

"At first, the use of the song without permission on the official TikTok account from Pertamina Patra Niaga. That was without the consent of the song's creator and also from the singer as the owner of the master, namely Wijaya 80," Andhika told the media after filing a complaint with the DJKI.

Erikson Jayanto added that the use of the song was not an accident of organic user uploads or User Generated Content (UGC). Based on their internal monitoring results, the uploaded video is a planned production that passes through the editing desk for the company's commercial purposes.

"Actually it's not from UGC, so it's already edited by the editor. It's already overdubbed too. So it's deliberately downloaded, then edited again," said Erikson.

Although the video content in question had been withdrawn by the corporation after being sent a warning via email, Wijaya 80 felt that material and immaterial losses had occurred.

Andhika stated that his party had tried to be cooperative by sending two summonses before finally taking the path of an official complaint. However, the meeting that had previously occurred was considered to have only given promises without realization.

"We have also met with them, but yes, there has been no concrete results. It's just promises, (he said) waiting to be resolved in the near future so that it's a win-win solution," added Andhika.

Now, by including evidence in the form of promotional footage and ownership documents for the song, Wijaya 80 hopes that the relevant authorities can act fairly.

They demand the fulfillment of economic rights as regulated in legislation, so that it becomes a lesson for industry players in appreciating the intellectual work of local musicians.

"We just want to ask for justice for our client PT Suara Wijaya Abadi and also Mas Hezky Joe as the song creator. In addition to justice, of course, economic rights are fulfilled in accordance with Article 9 and Article 24 of the Copyright Law," concluded Andhika.
