The Constitutional Court Receives Improvements For Applications For Material Tests Of The Copyright Law From 29 Singers

The Constitutional Court received an improvement in the judicial review of the VISION Copyright Law (MK)

JAKARTA - The preliminary hearing for the agenda of improving the judicial review application of Law No.28 of 2014 concerning Copyright was held at the Constitutional Court on Wednesday, May 7.

Three panel judges consisting of Saldi Isra, Enny Nurbaningsih, and Arsul Sani have received an application from 29 singers members of the Indonesian Voice Vibration (VISION) represented by their legal team.

Constitutional judge Saldi Isra said that the request for judicial review that had been received would be discussed with other constitutional judges, to determine the next steps.

"The three of us will present an applicant to explain to other judges," said Saldi Isra, citing the Indonesian Constitutional Court's YouTube show.

"Later we will leave it to all constitutional judges to have an opinion. If they say we still need to deepen the plenary and the majority agree to be brought to plenary (will be held plenary), but if the majority says this, there is no need for plenary and we already understand, yes, no plenary, "added Saldi.

Meanwhile, the decision to have a plenary session will be further reported by the Constitutional Court next week.

"Developments will be notified to the applicant or the applicant's attorney through the clerk of the Constitutional Court," said Saldi. If this is held in plenary, for example, later all the parties who are fighting will come.

Through a press release received by VOI, 29 singers in the revision of the application have included evidence of constitutional losses suffered by Tantri KOTAK and Hedi Yunus.

Tantri, KOTAK's lead vocalist, was forced to stop performing hit songs by former personnel due to bans and subpoenas, although the songs have become an important part of his career and musical identity.

Meanwhile, Hedi Yunus, a senior singer who is also a member of Kahitna, had to stop the appearance of the song 'Profiling' due to pressure on the use of direct licenses which caused legal fear.

VISI considers this situation a form of systemic injustice that limits the expression space of musicians and other performing actors, and contradicts the guarantee of the right to security, legal certainty, and freedom of work, as stated in Article 28D paragraph (1) and Article 28G paragraph (1) of the 1945 Constitution.
