OJK and Kejaksaan Strengthen Synergy in Handling Criminal Acts in the Financial Services Sector

JAKARTA - The Financial Services Authority (OJK) and the Republic of Indonesia Prosecutor's Office (RI) signed a Cooperation Agreement (PKS) in order to strengthen the synergy in handling and resolving criminal cases in the financial services sector.

Deputy Chairman of the OJK Commission Board Mirza Adityaswara conveyed the importance of OJK synergy with the Attorney General's Office of the Republic of Indonesia in enforcing laws related to criminal acts in the financial services sector.

"This PKS is expected to facilitate better, more solid cooperation, of course, primarily in the business process related to handling investigations into criminal acts in the financial services sector at OJK," said Mirza as stated in an official statement in Jakarta, quoted by Antara, Tuesday, January 20.

He said the mandate of Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (UU P2SK) which was given to the OJK in conducting investigations could not be carried out without good collaboration with law enforcement agencies.

On the same occasion, the Deputy Attorney General for General Crime of the Attorney General of the Republic of Indonesia, Asep Nana Mulyana, interpreted the signing of the PKS as a form of synergy and collaboration which is a mutual commitment between the two parties.

"With the PKS between us and OJK, we are further strengthening, strengthening our joint commitment to jointly resolving this matter, together to really succeed in this matter," said Asep.

Asep emphasized the importance of inter-agency cooperation to deal with increasingly complex financial crimes in the current digital era, as there are many new modus operandi, especially related to cryptocurrencies, so that solid synergy is a necessity.

The signing of the PKS is an update and improvement on the previous PKS between OJK and the Attorney General's Office of the Republic of Indonesia which was determined on January 12, 2024, in line with the enactment of Law Number 20 of 2025 concerning the Criminal Procedure Law Book which brought fundamental changes to the mechanism for handling criminal cases.

During the period 2017 to 2025, the coordination between OJK and the Attorney General's Office of the Republic of Indonesia showed consistent and effective performance, of which 176 financial services sector criminal cases were declared complete (P-21), consisting of 140 banking cases, 9 capital market cases, and 27 financial industry cases. non-bank.

Of this number, 135 cases have obtained a ruling with the force of law (inkracht).

Specifically in 2025, the completion of the case file up to the P-21 stage reached 37 case files, consisting of 27 banking cases, four capital market case files, and six IKNB case files.

This cooperation update aims to ensure that the implementation of the duties and powers of investigation by the OJK and prosecution by the Attorney General's Office of the Republic of Indonesia can run optimally and in accordance with the provisions of the new criminal procedure law.

Through the PKS, OJK and the Attorney General's Office of the Republic of Indonesia strengthen coordination from the initial stages of handling cases to support law enforcement in the financial services sector that is synergistic, accountable, and in line with the provisions of laws and regulations.

The scope of PKS includes strengthening coordination in handling and resolving criminal cases in the financial services sector at the investigation, pre-prosecution, prosecution, and court ruling stages, as well as the provision, exchange, and utilization of data and/or information.

In addition, this cooperation also includes the implementation of seminars, workshops, and socialization to increase the capacity and understanding of parties in handling cases in the financial services sector.

With the signing of the PKS, OJK and the Attorney General's Office of the Republic of Indonesia confirm their joint commitment to strengthen synergy and cooperation in handling criminal cases to support law enforcement in the financial services sector.
