JAKARTA - The government officially issued Government Regulation (PP) Number 28 of 2025 concerning the Implementation of Risk-Based Business Licensing on June 5, 2025.

This regulation will take full effect on October 5, 2025, after a four-month transition period.

Secretary of the Coordinating Ministry for the Economy Susiwijono Moegiarso said that this socialization was the first step to introducing the substance of PP 28/2025 in general.

He added that during this transition period, the government planned several socialization activities, including those that were thematic in accordance with the authority of each ministry/institution, especially those related to fulfilling the basic licensing requirements.

"For example, from friends from the Ministry of ATR/BPN, from the Ministry of Environment, Ministry of Forestry, Ministry of Maritime Affairs and Fisheries, and the Ministry of Public Works, later we can organize this basic requirement, the thematic socialization which specifically discusses licensing in several ministries that issue the basic requirements," he said in the socialization agenda, Monday, June 30.

He emphasized that the issuance of PP 28/2025 is proof of the government's commitment to building a more conducive, effective licensing ecosystem and supporting increased investment.

Susiwijono added that the contribution of investment to economic growth is very significant, this regulation is expected to be able to simplify the licensing process, accelerate services, and ensure legal certainty for business actors.

Susiwijono also said that there are three main points in PP 28/2025 that are the difference between the first PP 5/2021, namely the implementation of Service Level Agreement (SLA) where every stage in the licensing process, starting from registration, document assessment, verification to issuance of permits, is given a clear service time limit.

"So far, business actors have complained about the time uncertainty related to the issuance of this business license, therefore all licensing, especially those with the basic budget in PP 28/2025, has been set a deadline or Service Level Agreement. For example, maybe in ATR friends, BPN then also at KKP related to the sea is related to the approval of the KKPR, for example," he explained.

He gave an example, such as the process of assessing the suitability of activities and space utilization by ATR/BPN given a time limit of 25 working days without improvement, or 40 working days if there is improvement, this aims to provide certainty of service time to business actors.

"Thus, it is hoped that the level of service time at each stage will make the entire licensing service process clearer and more certain. This is the first thing, so the new thing that will be confirmed correctly in PP 28 is that the entire process of issuing company licensing will implement service level agreement or service time level," he said.

He conveyed the second point, namely the application of Fictitious-Positive Policy where if government agencies do not provide a response within the period determined by SLA, the permit is considered to have been issued automatically and the system will proceed to the next stage.

Susiwijono said that this policy was implemented in five main ministries/agencies that formulated basic requirements as well as in six technical sectors such as the Ministry of Agriculture, Ministry of Energy and Mineral Resources, Ministry of Industry, Ministry of Tourism, Ministry of Marine Affairs of Fisheries, and Ministry of Manpower.

"This will later treat the fictitious policies in providing business licensing services," he said.

He added the third point, namely full integration into the Online Single Submission Risk Based Approach (OSS-RBA) system where all business licensing must be processed through the Risk-Based OSS system managed by the Ministry of Investment/BKPM.

"So far, OSS-RBA has been running since PP 5/2021, but some of the Ministry of Institutions' systems are still running, so with PP 28, it is mandatory to integrate into the OSS-RBA system," he said.

According to him, this confirms that OSS-RBA is the only official licensing platform, replacing the internal system of ministries/agencies that previously ran separately.

"The entire licensing process, starting from the fulfillment of basic permits, business licensing, then PPUMKU, licensing seeks to support business activities, everything is carried out electronically and integrated through the OSS-RBA system. With this system, business actors will be able to access all services online from all institutions. Ministry of Government Institutions that are connected and integrated in real time in this OSS-RBA system," he concluded.
