Offered A Utilization Scheme At Pontjo Sutowo, Ministry Of Finance Affirms Sultan Hotel Land Is BMN

JAKARTA - The Ministry of Finance (Kemenkeu) confirmed that related to the land dispute of the Sultan Hotel, the land is state property (BMN).

"I just want to make it clear that it is state property," said Director of State Wealth Policy, Ministry of Finance, Encep Sudarwan some time ago.

Previously, the Bung Karno Gelora Complex Management Center (PPKGBK) was said to have made an offer to those who used the land, namely Pontjo Sutowo's PT Indobuildco, to choose a number of utilization schemes. However, he said, the company did not agree.

Meanwhile, PPKGBK offers several utilization mechanisms that can be selected by PT Indobuildco if you want to stay in the GBK area at the time. The first scheme is rent, the second scheme for utilization cooperation (KSP), the third scheme is build operation transfer (BOT), and the fourth scheme is build transfer operation (BTO).

The next scheme is the cooperation of infrastructure providers (KSPI), other schemes, namely the limited contraction scheme (LCS), the next scheme, namely borrowing and so on.

"And my friends already know, they (Indobuildco) don't agree," he said.

Encep emphasized that his party as the manager of BMN will optimize the use and use of state-owned goods.

"Well, this is working on PPKGBK. So it's state property. The users of the goods are the State Secretariat (Ministry of State Secretariat). The State Secretariat has a BLU (General Service Agency) called PPKGBK and the one who manages the asset," he said.

In the future, Encep said that the land could be tendered and would optimize assets, especially those in premium locations.

"Later it could be tendered later who the highest bider is the winner will be. And we have to optimize the assets in premium location," he said.

For information, PPKGBK has provided a file in the form of Minister of Finance Regulation (PMK) Number 115 of 2020 concerning the Utilization of State Property (BMN) as a mediation corridor for further study by PT Indobuildco.

Meanwhile, the PPKGBK said that the Sultan Hotel land is a state-owned asset according to the Management Right (HPL) No. 1/Gelora in 1989 on behalf of the Ministry of State Secretariat (Kemensetneg) c.q PPKGBK. PT Indobuildco is considered not entitled to occupy the land because the Right to Use Building (HGB) has expired in March-April 2023.

On the other hand, PT Indobuildco stated that the management of the Sultan Hotel was based on HGB No. 26/27 of 1972, not on HPL land No. 1/Gelora. Regarding the exhausted HGB, his party claims that it still has the right to update in the next 30 years which has not yet been approved by the DKI Jakarta ATR/BPN Regional Office.
