JAKARTA - The handling of the case of pouring hard water on KontraS Deputy Coordinator Andrie Yunus continues. The TNI Puspom is still investigating the incident that occurred in the Senen area, Central Jakarta on Thursday night, March 12.
"I have to say that until now the investigation process for the 4 personnel suspected of torturing brother AY (Andrie Yunus) is underway," said TNI Deputy Chief of Staff, Major General Aulia Dwi Nasrullah to reporters, Tuesday, March 24.
The suspected perpetrator referred to as Aulia is a TNI soldier with the initials Captain NDP, Lettu SL, Lettu BHW, and Serda ES. These initials are different from those conveyed by the Polda Metro Jaya, namely BHWC and MAK.
Meanwhile, when asked about coordination with the Metro Jaya Police, Aulia did not want to say much. He asked all parties to wait for the legal process to run.
"Please wait until the entire investigation process by investigators from the TNI Puspom is completed," he said.
Meanwhile, the Coalition of Civil Society and the Advocacy Team for Democracy (TAUD) continues to urge the establishment of an Independent Joint Fact-Finding Team (TGPF). They see the difference as uncertainty in the legal process and existing facts.
"Therefore, we encourage verification by independent institutions such as the National Commission on Human Rights and the establishment of an Independent Fact-Finding Joint Team to produce objective and comprehensive facts that target field actors and intellectual actors," said TAUD representative from LBH Jakarta, Fadhil Alfathan.
Fadhil further said that the information provided by the TNI Puspom regarding the 4 suspected perpetrators who came from the TNI BAIS showed a serious violation of the TNI's intelligence function.
TAUD stated that BAIS serves as an early detection tool for threats directly related to the main tasks of the TNI as regulated in the TNI Law, not as a tool to spy on citizens. "Thus, a thorough evaluation and disclosure of intellectual actors and the motives for the actions are crucial," said Fadhil.
"In this context, the Minister of Defense as the author of defense policy and the commander of the TNI and the head of BAIS as the executor of the policy must be examined and held accountable for the involvement of soldiers under his command," he continued.
Not only that, TAUD demands that the president form a TGPF consisting of elements of civil society and directly under the president by consulting with the companion and family of the victims in its formation. They also ask the president to immediately order the TNI commander to hand over the perpetrators to be tried in a public court.
TAUD also asked the TNI Police to show the alleged perpetrators to the public. The goal is to ensure that they are all in good health, receive adequate legal assistance, and ensure the safety of field perpetrators from threats from parties who have the potential to damage and/or obstruct the investigation.
"Because the crime of attempted premeditated murder is a common crime and the victim is a civilian and ensuring the disclosure of the intellectual actors of this event without discrimination and the effective recovery of the situation for the victim," he explained.
