French Caucasian Motorcycle Thief In Kuta Bali Sued 8 Months In Prison

DENPASAR - The Public Prosecutor of the Badung District Prosecutor's Office, Bali, has charged French citizen Sammy Kevin Bensaid Usage (37) with eight months in prison for the theft of a motorbike in Kuta, Badung Regency, Bali.

"Demanding that the panel of judges who tried this case declare the defendant proven legally and convincingly guilty of committing the crime of theft as regulated and threatened in Article 362 of the Criminal Code," said the Public Prosecutor before the Denpasar District Court, Thursday, June 19.

As for the aggravating things to these demands, namely, the defendant's actions harmed witness (victim) Jonathan David Lukas and his actions disturbed the public.

Meanwhile, mitigating matters are that the defendant has never been convicted, has been polite and cooperative during the trial.

The defendant himself only fell down sluggishly hearing the prosecutor's demands.

The prosecutor in his indictment explained that Samy's series of actions began on Thursday (20/3) at around 20.00 WITA. At that time, the defendant went to the hotel lobby on Jalan Majapahit, Kuta, Badung where he lived to get the breakfast ordered. Then, he was approached by a reception.

The hotel clerk showed the key while asking 'is this your motorbike key?' and Samy answered that the key was not his. The next day at 12.00 WITA, this man went down to the lobby.

He was again questioned by a reception person with the same question regarding the motorbike key the day before. He again replied it was not his.

However, at around 19:00 WITA, the defendant Samy went down to the lobby and asked the reception "where is the key that was offered to me?".

Receptionist immediately handed over the object to the defendant.

After that, the defendant returned to his room. An hour later, he went to the basement parking lot of the hotel and took a gray Yamaha motor Nopol DK 2212 FDK which did not belong to him.

Then, the defendant entered the key that he had taken, until the vehicle turned on. Next the motorbike was taken away to meet a female witness named Winona Auliafebe Suryawijaya at the boarding house, Jalan Nuri, Dangin Puri Kaja Village, North Denpasar.

At that place, the defendant informed the witness that he wanted to exchange the motorbike. When asked why he exchanged, Samy only replied that he had been exchanged for a few days. However, the witness rejected the request.

Shortly after, the motorbike, which did not belong to him, was taken to Lombok, East Nusa Tenggara, to visit his son there.

Meanwhile, the owner of the motorbike in the name of Jonathan David Lukas reported the loss of a motorbike at the Kuta Police.

The police, who had the identity of the perpetrator, were looking for and managed to arrest the perpetrator until he was finally tried at the Denpasar District Court.
