Menkum Advises Those Who Object To The New TNI Law To Submit Judicial Review At The Constitutional Court

JAKARTA - Minister of Law (Menkum) Supratman Andi Agtas stated to all parties who still object to the latest TNI Law (UU TNI), they can take a judicial review route at the Constitutional Court (MK).

Supratman, at the Presidential Palace complex, Jakarta, Friday, emphasized that this mechanism is part of a state administration system that allows the public to test the laws that have been passed by the DPR and the government.

"Let him be tested, whether it is true that the concern is indeed something fundamental to do or not," he said, responding to the rejection of a number of groups against the TNI Law, Friday, March 21, which was confiscated by Antara.

Supratman appealed to the public to let the new TNI Law be implemented first. If anyone objected, there would be constitutional channels such as a judicial review to test it.

He emphasized that there should not be excessive dichotomy between various national powers, because the Republic of Indonesia was founded by various groups and professions with balanced roles in developing the country.

"The point is, it is impossible for us to agree in all respects because it is part of our destiny to be democratic. Therefore, there are still other channels that can be used," he said.

On that occasion, Supratman ensured that the TNI Law which had been ratified at the DPR Plenary Session did not contain elements of the TNI's dual function as feared by some parties.

He explained that this new rule actually provides clear limits regarding civil office that military personnel may fill.

Regarding criticism of the lack of transparency in the discussion of this bill, Supratman denied it. The reason is that discussions have been carried out since the previous period.

"In this law, I used to initiate time in the legislative body, it was 2024, but it didn't happen at that time, because the government had not completed the DIM. Therefore, it became a carryover in the current period," he said.
