MUI Harams Primary And Consumptive Goods Tax
JAKARTA The Indonesian Ulema Council (MUI) has set a fatwa that consumptive and primary goods are not subject to taxes. MUI also proposes that people who pay zakat can be taken into consideration to reduce the value of tax obligations.
This fatwa was issued in the Fatwa Commission Session at the MUI XI National Conference forum in Jakarta, Saturday night. MUI has agreed on a fair tax fatwa, how is the relationship between the people and the authorities, in this case the government, is tied up in mutual relations that strengthen each other for the purpose of realizing benefit. And taxes, are intended as instruments to realize the welfare of the community," said MUI Fatwa, Asrorun Niam Sholeh in a written statement, Sunday, November 23.
MUI has also published several tax conceptions. First, taxes are only imposed on citizens who have a financial capacity where the amount is syar'i equivalent to nisab zakat mall, which is 85 grams of gold.
Second, tax objects are imposed only on potential assets to be produced, or are secondary needs and tertiary needs.

"So in the fiqh it is categorized as a hajiyat and also a tahsiniyat, not a need for dharuriyat, not a primary need," continued Asrorun.
Third, the tax paid by the taxpayer is shaarly owned by the people. As for the management of taxes, it is mandated to the government through the Directorate General of Taxes. Fourth, the goods that are the primary needs of the community should not be burdened with repeated taxes. Fifth, consumptive goods that are primary needs, especially basic necessities, should not be burdened with taxes.
Sixth, the inhabited earth and buildings, in the non-commercial sense, should not be subject to repeated taxes, because in essence they do not develop. Seventh, citizens are required to obey the tax rules stipulated based on the provisions. However, tax collection that is not in accordance with the provisions is illegal.
"Well finally, zakat that has been paid by Muslims has reduced tax obligations. Now, I think this is a new thing, to guarantee justice, including participatory justice," said Asrorun.
