MK Registration For 309 Cases Of Dispute In The 2024 Regional Head Elections, Different From The Number Of Applications
JAKARTA - The Constitutional Court (MK) has officially registered as many as 309 cases of dispute over the election results of governors, regents, and mayors or regional election disputes in 2024 as of Friday at 14:49 WIB.
"Today, January 3, 2025, a case registration has been carried out for incoming applications. The number is 309 cases of dispute over the results of regional head elections," said Head of the Public Relations and Protocol Bureau of the Constitutional Court Pan Mohamad Faiz when met at Building I of the Constitutional Court, Jakarta, January 3, as reported by Antara.
A total of 309 cases registered consist of 23 cases of governor election, 237 cases of regent election, and 49 cases of mayor election.
Meanwhile, the number of registered cases is different from the number of registered applications. Judging from the official website of the Constitutional Court, the total number of election disputes registered reached 314 applications.
There is a difference in terms between the petition and the case. So, when it was submitted it was still [called] an application, when it was registered it turned into a case," explained Faiz.
According to him, the difference in the number of applications and cases could occur because the Court conducted a file examination. When the Constitutional Court finds a double application, only one of these applications is registered as a case.
"For example, there are prospective applicants who submit their applications online and offline twice, so we will not register both of them. The applicants are the same, the legal counsel is the same, so we will register only one. So, there are some of them that we do not register because they have been represented, whether from the online application or from the offline first, "he said.

After registering the case, continued Faiz, the Constitutional Court will write to the regional KPU with a copy of the central KPU as the respondent, including Bawaslu as the relevant party. In addition, other parties who want to apply as related parties have had two working days since the case was registered.
"So the last day (registration as a related party) is Monday [On January 6]. Well, from there there there will be an RPH (meeting of the judge's deliberation) determining whether they will be accepted as related parties or not," he added.
Furthermore, Faiz said the inaugural hearing with a preliminary examination agenda would be held on Wednesday (8/1). The trial will be held using a panel method, each panel consisting of three constitutional judges.
Based on Constitutional Court Regulation Number 14 of 2024, a trial with a trial agenda will be held on 17 January 4 February 2025. At this stage, the Constitutional Court listened to the KPU's answer as the respondent, related party statements, and Bawaslu's statement, and ratified the evidence.
The RPH to discuss the case and take a decision regarding whether or not a case to a follow-up trial is scheduled for February 5'10, 2025. The trial for expressing the final decision/decision of the 2024 Pilkada dispute will be held on March 7, 2025.
