NTB SP3 Police Alleged Corruption In PT GNE BUMD SPAM Project

West Nusa Tenggara (NTB) Regional Police (Polda) has stopped investigating the alleged corruption case of the government's capital investment budget to PT Gerbang NTB Emas (GNE) as the organizer of the regional drinking water supply system (SPAM) in 2019-2022.

Head of Public Relations of the NTB Police, Adjunct Senior Commissioner of Police Muhammad Kholid, admitted that he was not aware of the termination of the investigation of the case in accordance with the letter of termination of investigation (SP3) Number: S.Tap/52/XII/2023/Ditreskrimsus dated December 29, 2023.

The SP3 was issued in Mataram and signed by the Director of Special Criminal Investigation of the NTB Police, Senior Commissioner of Police Nasrun Pasaribu on behalf of the NTB Police Chief as investigators.

In the SP3, the NTB Police stopped the investigation originating from reports or public complaints about alleged corruption in the form of abuse of authority and position taking into account the results of the case title on December 20, 2023.

The NTB Regional Police stated that the report did not fulfill the elements of the article as stipulated in Article 2 paragraph (1) or Article 3 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001.

So that in the letter it is stated that based on the results of the examination at the level of investigation, it is deemed necessary to stop the investigation by issuing a letter of termination of the investigation.

PT GNE as a regional-owned enterprise (BUMD) of NTB was recorded as holding this regional SPAM project based on the direct appointment of the Governor of NTB Zulkieflimansyah in accordance with the issuance of the Governor Regulation (Pergub) NTB Number: 500 560.

Following up on the governor's regulation, PT GNE carried out two methods of project implementation. First, the SPAM Regional Project Se-Lombok Island which will be held through the government's cooperation process with business entities (KPBU).

Second, "business to business" using the "Sea Water Reverse Osmosis" (SWRO) method to support the availability of clean water in areas that are difficult to reach by the PDAM network.

In 2019, it was recorded that PT GNE signed a memorandum of understanding in cooperation with foreign investors, namely McKinley Investment, which is a joint investor from three countries (United States, Korea and Japan).

Furthermore, PT GNE at the end of January 2020 was also recorded as signing a memorandum of understanding in cooperation with PT Potum Mundi Infranusantara (Potum). The investment value of the cooperation was approved with a figure of IDR 2 trillion.

In signing the memorandum of understanding, PT Potum acted as the company that built the SPAM infrastructure. Meanwhile, PT GNE as the manager.

Cooperation includes providing systems for water services in North Lombok and Mataram City as well as strategic areas in three Gili (Trawangan, Air, and Meno) and Senggigi. In addition, Potum will also support the provision of water systems for services for the Mandalika Special Economic Zone (KEK).

From the signing of the cooperation, the Governor of NTB and a number of regional officials were also present to witness.

Furthermore, there is cooperation between PT GNE and PT Berkat Air Laut (BAL) in providing clean water in Gili Trawangan and Meno. However, the government in December 2022 officially revoked the permit because the provision of clean water by PT GNE in collaboration with PT BAL came from groundwater.

The case of cooperation in water management with PT BAL has now entered the final round at the Mataram District Court, waiting for the agenda of the verdict hearing which will be held on Thursday, October 31.

Samsul Hadi as a former Director of PT GNE and William John▁Cinta as Director of PT BAL was dragged as a defendant suspected of exploiting water resources in the Gili Trawangan tourist area.
