PDIP Waits For Megawati's Direction To Follow Up On The Administrative Court's Decision Not Accepting Lawsuits Related To Gibran
The PDI-P has not yet decided whether to take further legal steps regarding the decision of the State Administrative Court (PTUN) which does not accept the lawsuit.
The Administrative Court has decided not to accept the PDIP's lawsuit regarding the unlawful act of the General Elections Commission (KPU) which ratifies Gibran Rakabuming Raka's candidacy in the 2024 presidential election.
PDIP Legal Team Chairman Gayus Lumbuun emphasized that his party had fully handed over the continuation of legal action to PDIP General Chair Megawati Soekarnoputri.
"If later the General Chair orders us, we will do what is authorized," said Gayus at the PDIP DPP office, Central Jakarta, Friday, October 25.
However, Gayus admitted that he was hesitant if PDIP continued the appeal against the results of the Administrative Court's decision. Gayus reflected on the dismissal decision of the Administrative Court which stated that the PDIP's lawsuit against the KPU was accepted. However, in the process the judge in the Administrative Court rejected the lawsuit.
"If you can have personal opinion about Gayus Lumbuun, I say you don't have to make other legal remedies. Appeals or other legal remedies, as long as our judicial conditions are like this. Judges do not feel determined, judges do not feel safe to make decisions as they should," said Gayus.
Basically, PDIP respects the court's decision. However, Gayus considered that there were irregularities in the judge's attitude in handling the case filed by PDIP in his petitum regarding the KPU committing an unlawful act against Gibran's candidacy.
"We need to question the judge who decides because there are very strange things," said Gayus.
The oddity revealed by Gayus was related to the postponement of the reading of the case verdict. Initially, the verdict schedule was read out on October 10, 2024.

However, the Administrative Court postponed it until October 24 or after the inauguration of the President-Vice President. The reading of the verdict was postponed on the grounds that the chairman of the panel of judges was sick. In fact, Gayus assessed that the verdict could still be read out on October 10.
"The decision on the 10th can be submitted, because this does not have to be a trial in court. At home, in a hospital, anywhere can and is legal," he explained.
For information, the PDI-P filed a lawsuit with the Administrative Court because it considered the Indonesian KPU to have committed legal acts in the 2024 presidential election process. The lawsuit is registered with Case Number 133/G/TF/2024/PTUN.JKT.
PDIP meminta PTUN Jakarta menyatakan tindakan KPU sebagai penyelenggara Pemilu 2024 sepanjang mengenai pemilihan presiden dan wakil presiden merupakan perbuatan melanggar hukum oleh pejabat pemerintah.
In its petitum, PDIP also requested that the Administrative Court oblige the KPU not to take administrative action as long as it relates to the interests of the inauguration of the elected vice president candidate for the 2024 '2029 period on behalf of Gibran Rakabuming Raka.
On October 24, the Administrative Court declared that the PDIP lawsuit was not accepted. The Administrative Court also charged the PDIP Rp325 thousand case fee as the plaintiff.
