Komnas HAM Continues To Strive For The Government To Remove The Death Penalty
JAKARTA - The Indonesian National Human Rights Commission (Komnas HAM), in response to World Death Penalty Day which is commemorated every October 10, encourages the government to continue to seek the abolition of the death penalty.
Komnas HAM chairman Atnike Nova Sigiro said, since the Second Optional Protocol in the International Convention on Civil and Political Rights (ICCPR) was adopted in 1991, the abolition of the death penalty is an international standard of norms that are mainstream.
"As an international standard of norms, the Indonesian government needs to be consistent in drafting a Government Regulation that is in line with developments that already exist in the new National Criminal Code," said Atnike in Jakarta, Thursday, October 10.
Provisions regarding the death penalty, added Atnike, are contained in Article 6 paragraph 1 of the ICCPR which states that every human being has the right to life and has the right to legal protection and no one can revoke that right.
Meanwhile, in the new National Criminal Code, the provision of the death penalty is regulated as an alternative punishment and there are also rules regarding the postponement of the execution of the death penalty.
On the other hand, the Indonesian government has prepared a Draft Government Regulation on Procedures for Change in Life and Death Crimes.
Furthermore, Komnas HAM assessed that the government needs to consider a moratorium or suspension of the implementation of the death penalty as well as the abolition of the implementation of the death penalty for new cases.
"To support the implementation of the elimination of the death penalty in Indonesia, the Second Optional Protocol ratification is an important thing for the government to implement," said Atnike.

The abolition of the death penalty is firmly stated in The Second Optional Protocol to the ICCPR. Indonesia is one of the countries that has ratified the ICCPR through Law Number 12 of 2005 concerning Ratification of the ICCPR.
