Decision Of Threshold Of Regional Head Elections Disallowed By DPR, MKMK: Naked Disobedience
JAKARTA - Chairman of the Honorary Council of the Constitutional Court (MKMK) I Dewa Gede Palguna assessed the meeting of the Legislation Body (Baleg) of the DPR RI as naked disobedience to the Constitutional Court's decision.
The Legislative Meeting of the DPR RI was known to discuss the revision of the Pilkada Law, the results of which did not accommodate the Constitutional Court's decision as a whole. In fact, there were decisions that were disallowed.
"This method, for me personally, is nudity disobedience to the court's decision, c.q. The Constitutional Court, which is none other than a state institution by the Constitution (UUD 1945), is tasked with overseeing the 1945 Constitution," Palguna said when confirmed, Wednesday, August 21.
According to him, no one can do anything about the revision process. The reason is because the Constitutional Court is an institution that examines the law.
"Yes, nothing, it is beyond the authority of the Constitutional Court," he said.

Currently, said Palguna, the formation of the Law will be faced with a meeting that will thoroughly assess this matter.
"It's just that behavior is faced with the people and civil society as well as campus circles. Even then, if they are not tired. The Constitutional Court is a court that, like the court's excavation, can only act if there is a request," said Palguna.
On Tuesday, August 20, the Constitutional Court issued case decisions number 60/PUU-XXII/2024 and number 70/PUU-XXII/2024.
In its decision case number 60/PUU-XXII/2024, the Constitutional Court changed the threshold for nomination of regional heads in the regional elections. The Constitutional Court allows parties to have no seats in the DPRD to participate in carrying regional head candidates, as well as reducing the amount of the nomination threshold.
Meanwhile, in the case decision number 70/PUU-XXII/2024, the Constitutional Court rejected the lawsuit for changing the age limit for regional head candidates, so that the candidate for governor-deputy must at least 30 years during the determination of the candidate.
Suddenly, today, the DPR Baleg agreed that the age rules for regional head candidates would still follow the decision of the Supreme Court (MA), not the Constitutional Court.
The Supreme Court's decision states that the age of cagub-cawagub is at least 30 years, and 25 years for candidates for mayors-candidates for deputy mayors starting from the time they are sworn in.
