Proven Money Politics, Democratic Legislative Candidate In Nunukan Sentenced To 1.5 Months In Prison

The panel of judges at the Nunukan District Court (PN), North Kalimantan (Kaltara) sentenced him to 1.5 months in prison and a fine of Rp. 15 million or a subsidiary of 1 month in prison to the defendant Siti Rosita Binti Ahmad (22). The defendant was proven to have committed money politics.

The chairman of the Panel of Judges at the Nunukan District Court, Raden Narendra Mohdi Iswoyokusumo, said that the defendant as a participant in the election was legally and convincingly proven guilty of committing a crime of poltic money.

"The defendant Siti Rosita Binti Ahmad has been sentenced to imprisonment for 1 month and 15 days, and a fine of Rp. 15 million. With the provision that if the fine cannot be paid, it will be replaced with imprisonment for 1 month," he said, Tuesday, February 6.

Meanwhile, the Head of the General Crimes Section (Kasi), Amrizal R Riza, said that the prosecutor and the defendant's legal adviser expressed their thoughts.

"The judge's decision to the defendant is lighter than the prosecutor's (public prosecutor's office) demands are 4 months, with a fine of Rp. 15 million, subsidiary to 4 months in prison," said Amrizal, Tuesday (6/2/2024).

Amrizal emphasized that the defendant was legally and convincingly proven guilty of committing a criminal act in the election campaign and violated the prohibition on the implementation of the election campaign as referred to in Article 280 paragraph (1) letter j with a criminal threat in Article 521 of Law Number 7 of 2017 concerning Elections.

"The thing that burdens the defendant is that as a permanent candidate for members of the Nunukan DPRD in the 2024 election in the South Nunukan 2 electoral district, it does not set a good example during the election process," he said.

"The mitigating thing is that the defendant Siti Rosita has never been convicted and is still young," continued Amrizal.

Amrizal explained that Siti Rosita's actions were revealed on Sunday (10/12/2023) when the volleyball tournament tournament was held at the RT 02 field, Sedadap, South Nunukan.

Rosita's team proposed that door prizes be provided to socialize Siti Rosita as a candidate for legislature (valeg) for the DPRD for the 2 Nunukan electoral district from the Democrats.

"The defendant bought Miyako brand fans at a price of Rp. 298 thousand and Miyako dispenser for Rp. 241 thousand. The bowl and glass were also prepared for door prizes," he explained.

Furthermore, in the volleyball court, a Democrat banner was also installed, which contained a photo of the defendant wearing a Democrat uniform, equipped with a logo and party number bearing the Mercy star symbol.

"The actions of Defendant Siti Rosita fulfill the elements of promising acts or giving money or other materials to election campaign participants, as stipulated in Article 521 of Law Naomor 7 of 2017 concerning elections, or Article 523 paragraph (1) in conjunction with Article 280 paragraph (1) letter J Law Number 7 of 2017 concerning Elections," he concluded.
