Legal Reform Team Proposes Moratorium On Placement Of The TNI/Polri At Obvitnas
JAKARTA - The Legal Reform Acceleration Team formed by the Coordinating Minister for Political, Legal and Security Affairs Mahfud MD proposed to President Joko Widodo to temporarily suspend (moratorium) the placement of new members of the TNI and Polri in national vital objects (obvitnas).
In its short-term recommendation to the President of the Republic of Indonesia, the Legal Reform Acceleration Team proposed that the moratorium take place until there are independent studies of the rules, policies, procedures and implementations of the placement of police and military personnel to secure national vital objects.
The placement of the TNI/Polri for securing vital objects was discussed in the Environmental Working Group because they expected a moratorium to see the excesses that had so far emerged. The existence of these institutions is considered to increase escalation. Security of the TNI-Polri in national vital objects can also be seen for private companies. What is the right one to see? I think that's what is being pushed," said Member of the National Legal Reform Acceleration Team Rifqi Sjarief Assegaf when met after a press conference reported by ANTARA, Friday, September 15.
The Working Group of 2 for Agrarian Reform and Natural Resources (SDA) in its study recommended an independent study that re-examine the relationship between the placement of police and TNI soldiers in national vital objects and other corporate activities with security, human rights, and SDA conflicts.
The Legal Reform Acceleration Team proposed that the Coordinating Minister for Political, Legal and Security Affairs issue a decree (SK) to form an independent team tasked with reviewing the issue as well as formulating recommendations and roadmaps for policy improvements related to the placement of police and TNI soldiers in national vital objects and related corporate activities.
The related study and formulation are targeted to be completed in December 2023.
Then, according to the follow-up, the recommendation is expected to be implemented by the TNI and Polri in stages in March 2024, June 2024, and September 2024.

The Legal Reform Acceleration Team also proposed that the TNI and Polri issue a decree or the Chief of Police Instruction and the Instruction of the TNI Commander which temporarily suspended the new placement of police and TNI soldiers in national vital objects until there were results of studies and recommendations from an independent team formed by the Coordinating Minister for Political, Legal and Security Affairs.
The moratorium is expected to take place in December 2023.
In its recommendation documents submitted to the President of the Republic of Indonesia, the Legal Reform Acceleration Team considers the TNI and Polri to be quite a lot of institutions involved in cases related to agrarian conflicts and natural resources management.
Experts and experts who are members of the Legal Reform Acceleration Team assess that the placement of police and TNI soldiers only continues the repressive approach without solving the root problems of security disturbances to national vital objects.
