Indian Citizen Sentenced to One Year Despite Losing Victims of Up to IDR 15 Billion, North Jakarta Prosecutor Files Cassation
JAKARTA - The North Jakarta District Prosecutor's Office submitted an appeal to the Supreme Court (MA) against the one year prison sentence for an Indian citizen, Sathya Vrathan Biju Puzhakkadavil (51). The defendant was proven guilty of cheating in imported buffalo meat transactions.
Head of the Intelligence Section of the North Jakarta District Prosecutor's Office (Kejari) Aditya Rakatama hopes that the judge will apply the law properly and hand down a verdict that reflects a sense of justice for victims who suffered losses of up to IDR 15 billion.
"So that the Supreme Court's decision fulfills a sense of justice considering that the losses suffered by the victim witnesses are quite large," said Aditya when confirmed in Jakarta, Antara, Wednesday, September 13.
Sathya Vrathan Biju Puzhakkadavil has been sentenced to two years and six months (2.5 years) and one year and six months (1.5 years) in prison for defendant Yudi Safari in a trial at the North Jakarta District Court (PN) on Monday, May 8.
Considering that the prosecutor's initial demand for defendant Biju was three years and six months in prison (3.5 years) and two years in prison for Yudi Safari, Public Prosecutor (JPU) Ari Sulton then appealed the decision to the DKI Jakarta High Court.
However, the DKI Jakarta High Court (PT) judge decided to reduce Biju's sentence to one year at the trial on Tuesday, July 4.
The PT DKI judge's decision, chaired by Tony Pribadi, assessed that the defendant's actions fulfilled the elements of a criminal act of fraud together with Yudi as charged at the first trial stage at the North Jakarta (Jakut) District Court.

In his decision, the judge decided to impose a sentence of one year and six months for the defendant Yudi Safari. There is no mention of a clause requiring the defendant to return the money.
