2 PT SMA Officials Defendant Of Bandung Smart City CCTV Bribe Sentenced To 2 Years In Prison
BANDUNG - Hakim sentenced PT Sarana Mitra Adiguna (SMA) Benny and PT SMA Manager Andreas Guntoro to be accused of the Bandung Smart City CCTV procurement bribery case.
"The defendant I and Defendant II were each sentenced to 2 years in prison and a fine of Rp. 100 million, subsidiary to 3 months," said the Bandung Corruption Court Panel of Judges, chaired by Hera Kartiningsih, Monday, September 11, which was confiscated by Antara.
Hera emphasized that the two defendants were legally proven to have committed bribes in the CCTV project case at the Bandung City Transportation Service (Dishub).
Hera explained that the two defendants were proven to have given bribes to a number of officials in the city of Bandung, including the inactive Mayor Yana Mulyana, the Head of the Bandung City Transportation Agency Dadang Darmawan, and the Bandung City Secretary of Transportation Khairur Rijal worth IDR 585 million so that PT SMA gets a project to procure CCTV in the city of Bandung.
"To try, one declared the defendant one Benny and two defendants Andreas Guntoro guilty of committing a criminal act of corruption," he said.
The defendants Benny and Andreas were found guilty of the first alternative indictment, namely Article 5 paragraph (1) letter a or Article 13 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 in conjunction with Article 55 paragraph (1) of the 1st Criminal Code jo. Article 64 paragraph (1) of the Criminal Code.
The panel of judges invited the two defendants to appeal to the high court if the verdict was considered too heavy.
"You can accept this decision or you object or you can think about it within 7 days. If you object, you can file an appeal to the high court," said Hera.

The verdict given by the panel of judges against the two defendants was lower than the demands of the Corruption Eradication Commission (KPK) prosecutor, which was 2.5 years in prison.
Meanwhile, the KPK public prosecutor (JPU) Tito Jaelani said that his party would report in advance to its leadership the verdict.
"Regarding the decision, there is a difference with the demands, it is our matter to report it to the leadership, later whether the action is accepted by the decision or we file an appeal," said Tito.
The verdict against Benny and Andreas is higher than other defendants Director of PT CIFO Sonny Setiadi in a bribery case related to the procurement of an internet network which was sentenced to 1 year and 6 months in prison and a fine of Rp. 100 million, subsidiary to 3 months in prison.
