Absent From Further Examination, Police Can Still Hold Cases And Name Suspect Firli Bahuri

JAKARTA - The Indonesian Anti-Corruption Society (MAKI) assesses that Polda Metro Jaya investigators can directly carry out the process of titled a suspect in the alleged extortion case against the former Minister of Agriculture, Syahrul Yasin Limpo or SYL.

Although, KPK Chairman Firli Bahuri did not fulfill the summons for examination as a witness today.

"Investigators from Polda Metro Jaya can immediately hold a case without the presence of Mr. Firli," said MAKI Coordinator Boyamin Saiman when confirmed, Monday, November 7.

According to him, the case title process can still be carried out because Firli Bahuri has been questioned on Tuesday, October 24.

This is also said to refer to the decision of the Constitutional Court of the Republic of Indonesia No.21/PUU-XII/2014 and Article 184 of the Criminal Procedure Code which states that the requirements for determining suspects must be based on at least 2 pieces of evidence and accompanied by examination of potential suspects.

"That means that Polda Metro investigators can immediately hold a case of determination because what he said was that Pak Firli had been examined once," he said.

However, that does not mean that in this case Firli Bahuri will be named a suspect. However, the only requirement for the process of titled a suspect.

"So it could be that the suspect can be prepared for anything. For example, the giver or recipient or intermediary. It's possible that Mr. Firli actually doesn't know anything, right, he can just be named," said Boyamin.

Director of the Special Criminal Investigation of the Polda Metro Jaya Kombes Ade Safri Simanjuntak previously said that investigators would carry out the process of conducting a case of alleged extortion by the KPK leadership against Syahrul Yasin Limpo after an additional examination on November 7.

Meanwhile, Firli Bahuri, who is scheduled to provide information on that date.

"We will wait after an additional examination is carried out on Tuesday, November 7, 2023, later we will update it to media colleagues for follow-up steps to investigate which we will carry out next," said Ade.

However, the day before the examination, the KPK confirmed that Firli Bahuri would not fulfill the summons for investigation by Polda Metro Jaya investigators.

"There are activities in Aceh in the context of the KPK Bus Roadshow and also Hakordia in Aceh," said Head of the KPK News Section Ali Fikri.

Ali confirmed that the anti-corruption commission had sent a letter to the Polda Metro Jaya. Because Firli could not be present considering that he was out of town.

"I've sent a letter to confirm that's the absence. So it can be distinguished, friends between absent and confirmation," he said.
