Deputy Chairman Of Commission II F-PDIP Questions PKPU's Legislation During Registration Of Presidential And Vice Presidential Candidates

JAKARTA - Deputy Chairman of Commission II of the DPR from the PDIP faction, Junimart Girsang, questioned the General Elections Commission regarding the validity of KPU Regulation (PKPU) Number 19 of 2023 during the registration of prospective presidential candidates and presidential candidates on 19 October 2023.

"I don't question the decision of the Constitutional Court (MK), but I want concrete answers from the KPU. Whether the PKPU Number 19/2023 is still valid or not, whether Law Number 7 of 2017 concerning Elections is still valid," he said in a meeting with opinions reported by ANTARA, Tuesday, October 31.

Previously, the KPU had stipulated KPU Regulation (PKPU) Number 19 of 2023 concerning Candidates for the Presidential and Vice Presidential Elections. The KPU also stipulates the requirements for prospective presidential and vice presidential candidates. Article 13 Paragraph 3 concerning the requirements of the candidate, in which the presidential and vice presidential candidates are at least 40 (fourty) years old as referred to in paragraph (1) letter q, as of the determination of the candidate pair by the KPU.

However, on October 16, 2023, the Constitutional Court issued Constitutional Court Decision Number 90/PUU- XXV/2023, where the minimum age limit for presidential-cawapres is 40 years plus clauses that have served as regional heads.

"If you still use PKPU Number 19, is registration of presidential and vice presidential candidates valid?" said Junimart.

In Law Number 7 of 2017 concerning Election Article 75 where every PKPU or revision must and must consult with the DPR.

"This needs to be explained so that people who care about elections are not confused," Junimart hoped.

Commission II of the DPR RI held a hearing (RDP) with election organizers regarding the General Election Commission Regulation (PKPU) and the Election Supervisory Body Regulation (Bawaslu).

"This meeting is to discuss the PKPU draft and Bawaslu regulations," said Chairman of Commission II of the DPR RIAhmad Doli Kurnia when opening the RDP at the Parliament Complex, Senayan, Jakarta, Tuesday night.

The RDP Commission II was held with the Chairman of the KPU, the Chairman of Bawaslu, the Chairman of the Honorary Council of Election Organizers (DKPP), and the Director General of Politics and General Government of the Ministry of Home Affairs (Kemendagri).

The RPD has scheduled a consultation on the adjustment of KPU Regulations based on the Constitutional Court Decision Number 90/PUU- XXV/2023 and consultations on the draft Bawaslu regulations.
