Observers Consider It Fair For KPU To Be Sued For IDR 70.5 Trillion For Accepting Registration For Bukawapres Gibran

The General Election Commission (KPU) was sued at the Central Jakarta District Court (PN Jakpus) for alleged unlawful acts for accepting the registration of Prabowo Subianto and Gibran Rakabuming Raka presidential candidates. The KPU was asked for compensation of Rp70.5 trillion.

A political observer from Al Azhar University Indonesia Andriadi Achmad considered the lawsuit reasonable. Moreover, the decision of the Constitutional Court (MK) was considered legally flawed because it passed the lawsuit for the age limit for the vice presidential candidate at least 40 years unless he served as regional head. "In my opinion, it is natural that there is a lawsuit against an incident that is considered an indication of a violation of the law, including the lawsuit of one of the lecturers to the KPU because it is considered a violation of the election law by accepting the registration of presidential and vice presidential candidates Prabowo Subianto-Gibran Rakabuming Raka who are considered legally flawed," said Andriadi when contacted by VOI, Tuesday, October 31.

However, Andriadi reminded that there should be no hidden and politically charged intention to disqualify certain pairs of vice presidential candidates to run in the 2024 presidential election. Because according to him, if there was a violation, the KPU should have refused from the start.

"I really appreciate it if the intention is to enforce the rules or laws. But if there is political content to discredit certain candidate pairs, of course it doesn't feel good," he said.

Andriadi assessed that the public must wait for the decision of the Central Jakarta District Court. Whether to accept or reject the lawsuit.

"If it is accepted, then there is an opportunity for appeal and cassation from Prabowo-Gibran. If it is rejected, of course Prabowo - Gibran will walk as one of the candidate pairs in the 2024 presidential election contestation," he concluded.

Previously, a lecturer named Brian Demas Wicaksono sued the KPU for alleged unlawful acts for accepting the registration of Prabowo Subianto and Gibran Rakabuming Raka presidential and vice presidential candidates. The lawsuit was filed with the Central Jakarta District Court.

"Incidentally, as my plaintiff against the KPU, I am the plaintiff, my background as a lecturer, academic, I see that there was an unlawful act committed by the head of the KPU," Brian Demas told reporters at the Central Jakarta District Court, Jalan Bungur Besar Raya, Central Jakarta, Monday, October 30.

Demas assessed that the KPU should make changes to the PKPU according to the Constitutional Court's decision regarding the requirements for the presidential and vice presidential age limit. However, according to him, the PKPU changes were not carried out by the KPU but still received the registration of Prabowo and Gibran candidates.

"The chairman of the KPU should hold a hearing with the DPR first to make changes to the PKPU," he said.

"But this was not done by the chairman of the KPU, instead he accepted registration without changing the PKPU first," he continued.

Therefore, Demas assessed that Gibran's registration did not have the right legal basis or legal standing. Because it does not match what has been regulated in the PKPU that the condition is that there are only 40 years of no other editorial according to the Constitutional Court's decision.

"Therefore, this is an important lesson for state officials so that they don't play games, we are a state of law, we are a democratic country, when the law is lost, state officials will commit arbitrary actions that we experienced today, that is my basis for suing the chairman of the KPU and other commissioners," he explained.

Demas said that his party sued the KPU to pay compensation of Rp. 70.5 trillion. He said the compensation would later be returned to the state.

"The figure of Rp. 70.5 trillion is the figure conveyed by Minister Mrs. Sri Mulyani to the public that the election budget is that big. So the legal act carried out by the head of the KPU is a loss of Rp. 70.5 trillion, we will return it to the state later," he said.
