Mahfud MD Confident that Gakkumdu Can Anticipate Violations in the 2024 Election

JAKARTA - The Coordinating Minister for Political, Legal and Security Affairs Mahfud MD believes that the Integrated Law Enforcement Center (Gakkumdu) can anticipate violations that occur in the 2024 Election.

"We have to anticipate that there are no violations that can cancel and tarnish the election. Therefore, our legal instruments determine the need for integrated law enforcement", said Mahfud MD in the Sentra Gakkumdu Discussion Forum, as monitored online via the YouTube channel. According to him, Gakkumdu and other legal instruments are needed in the implementation of elections to guard democracy and nomocracy. He explained that democracy is a process of seeking victory, while nomocracy is a process of seeking truth.

"Democracy is win-win, nomocracy upholds the truth for those who win", he explained.

Mahfud emphasized that elections are one of the most important implementations in the implementation of democracy. The aim is to provide and guarantee the use of the constitutional rights of every citizen to exercise their rights in the life of the state.

"In the constitution of the Republic of Indonesia, the 1945 Constitution is so important regarding this election that it is regulated in at least 4 articles", he added.

He stated that Article 22 E paragraph (1) states that "General elections are held directly, publicly, freely, confidentially, honestly and fairly every five years". Then, Article 22 E paragraph (5) reads "General elections are held by an election commission that is national, permanent and independent".

The UII Faculty of Law professor revealed that the new rules were different from the old constitution. This is because the old constitution did not mention direct, general, free, secret, honest and fair elections.

"In the past (only) there were the words direct, general, free, secret, but dishonest and fair. So now being included direct, general, free and secret must be in the constitution and must be implemented honestly and fairly", said Mahfud.

For this reason, a General Election Commission (KPU) was formed outside the government structure or executive body headed by the president. According to the Constitutional Court (MK), the KPU together with Bawaslu and DKPP are state institutions led by the executive branch, but not part of an institution led by the president.

If there is an error in the election, it is the KPU that is being sued, because the government only facilitates the election. This is also so that the KPU becomes an independent institution.

"In fact, it is in Article 24 C of the 1945 Constitution concerning the existence of the Constitutional Court, if the election has been held, how come there is still fraud about the results. Because the process is not correct, the state provides a court called the Constitutional Court which never existed before", he said.
