Aceh Prosecutor's Office Confiscates 1,306.5 Hectares Of Plantation Land Related To Alleged Land Crimes In Aceh Tamiang
BANDA ACEH - Aceh High Prosecutor's Office (Kejati) investigators have confiscated plantation land with an area of 1,306.5 hectares (ha) from two palm oil companies involved in alleged land crimes in Aceh Tamiang Regency.
The head of the Aceh Attorney General's Office, Bambang Bachtiar, stated that the confiscated land consisted of PT Desa Jaya Alur Jambu plantations with an area of 429 hectares and PT Desa Jaya Alur Meranti plantations with an area of 877.5 hectares. Both lands are located in Aceh Tamiang Regency.
"The alleged land corruption case involves three suspects, namely TY, TR, and M. The three suspects have now been detained," said Bambang, quoted by Antara.
The confiscated plantation land was then entrusted to PT Perkebunan Nusantara (PTPN) I to be managed and optimized as confiscated assets.
In addition to plantation land, investigators also confiscated six land certificates in the names of suspects TY and TR, as well as four certificates of cultivation rights on behalf of PT Desa Jaya in Sungai Liput Village, Kejuruan Muda District, Aceh Tamiang Regency.
Bambang Bachtiar said that currently investigators are still examining witnesses and suspects related to this case. It is estimated that state and economic losses reached Rp46.8 billion.
Previously, the Aceh Attorney General's Office named TY, TR, and M as suspects in alleged land corruption in Aceh Tamiang Regency. They are suspected of controlling the former right to use (HGU) land and reselling it to the state.
Suspect M is the Head of the State Land Agency (BPN) of Aceh Tamiang Regency. TY is the director of the holding company of former HGU and TR allegedly receiving compensation money from state land.

The chronology of the case began with the issuance of two HGU rubber plantations by PT Desa Jaya in 1963. The first HGU was 885.65 hectares and the second HGU with an area of 1,658 hectares. The validity period of the two HGUs was 25 years and ended in August 1988.
Since HGU's permit ended in 1988, the company does not have a land rights and licensing permit to continue its plantation business. In 2009, TR as the company's management applied for a certificate of ownership of state property.
The land certificate is intended to get payment from land acquisition for the construction of the Aceh Tamiang Makodim. However, the land proposed is state property.
Then, M as Head of BPN Aceh Tamiang Regency issued a land certificate from the country. Some time later, the Aceh Tamiang Regency Government paid compensation for the land to TR with a value of Rp. 6.43 billion.
The suspects were threatened with Article 2 Paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 which was amended by Law Number 20 of 2001 concerning the eradication of criminal acts of corruption in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code, and Article 3 Paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 which was amended by Law Number 20 of 2001 concerning the eradication of criminal acts of corruption in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code.
