BEKASI - The District Attorney's Office (Kejari) of Bekasi Regency, West Java, has filed an appeal against the life sentence against the defendant in the murder case accompanied by the mutilation of Dicky Listhianto (38) with the victim with the initials AHW (54) or Angela.

"We appeal the decision in question. Furthermore, we will submit this memorandum of appeal to the West Java High Court through the Cikarang District Court," said Bekasi District Attorney (JPU) Widyatmoko as reported by ANTARA, Tuesday, September 26.

He said the appeal stage was submitted after the public prosecutor's team decided to think about it for a maximum of a week against the verdict of the Cikarang District Court Judge on Monday (18/9).

"We have coordinated with the leadership. So, three days after the verdict hearing, namely last Thursday (21/9), we declared an appeal," he added.

His party still refers to the provisions of Article 340 of the Criminal Code related to the premeditated murder committed by the perpetrator against the victim with legal facts which are believed to be the motive for the premeditated heinous murder.

This fact is that the perpetrator killed because he intended to control the victim's property, by proving the law of the apartment unit along with the certificate that belonged to the perpetrator after the murder incident.

"Then, Rp130 million was found belonging to the victim which was also taken by the perpetrator, even Rp50 thousand in the victim's wallet was also taken," said Widyatmoko.

Based on the facts of the trial, the Bekasi District Attorney's team of public prosecutors appealed and asked the West Java High Court to decide the death penalty for the perpetrators.

"Later, after we submit this memorandum of appeal, we will just have to wait for the decision of the high court. They will of course study the case file for this case first before deciding," said Widyatmoko.

On Monday (18/9), the panel of judges of PNCikarang sentenced the defendant Dicky Listianto (38) to life imprisonment for a murder case accompanied by mutilation.

The judge believes that the defendant violated the indictment of Article 339 of the Criminal Code regarding the heavier murder, subsidiary to Article 338 of the Criminal Code regarding murder. Dicky also violated Article 181 of the Criminal Code for hiding Angela Hendriati's body.

However, the panel of judges stated that Dicky was not legally and convincingly proven guilty of violating Article 340 of the Criminal Code related to premeditated murder.

A spokesman for the Cikarang Isnandar Nasution District Court, on the agenda of the prosecution hearing, said that the defendant Ecky was charged with the death penalty by the Public Prosecutor for the murder of the victim.

"The prosecutor's demand on the agenda of the previous trial is the death penalty, because the defendant is considered to have committed premeditated murder and hidden the victim's body as stipulated in Article 340 of the Criminal Code and Article 181 of the Criminal Code," said Isnandar.

Dicky Listianto became a defendant in the mutilation case of a woman named Angela. Angela's body was found in a rented house having her address at Buaran Village RT 01/02, Lambangsari Village, South Tambun District, Bekasi Regency, at the end of December 2022.

Before being found dead, Angela was reported missing by her family since 2019. After a series of investigations, the police named Edy as the perpetrator of the sadistic murder.
