Ambon District Court Sentenced To 9 Years In Prison Defendant Of Premeditated Murder Imanuel Berahi
MALUKU - The Ambon District Court (PN) panel of judges sentenced Imanuel Berahi to 9 years in prison as a suspect in a premeditated murder case against the victim Elvianus Siahaya.
"Declaring that the defendant is legally and convincingly proven guilty of violating Article 340 of the Criminal Code and imposing a sentence of nine years in prison minus the period of detention," said Chairman of the Ambon District Court Judges, Martha Maitimu in Ambon, Maluku, Monday, May 29, confiscated by Antara.
The judge said the aggravating thing for the defendant was because his actions caused another person to die.
While mitigating matters, the defendant admitted his actions, had never been convicted, and the defendant's house in Hulaliu, Haruku Island District, Central Maluku Regency was heavily damaged due to being the target of the residents' tantrums.
The judge's decision was also lighter than the demands of the Central Maluku District Attorney's Office, Junita Sahetapy and Fernanda E. Tupan, who in the previous trial asked the defendant to be sentenced to 15 years in prison.
Based on this decision, both the prosecutor and the defendant through their legal advisor expressed their thoughts so that they were given the opportunity for seven days and this decision did not yet have binding legal force.

Meanwhile, the defendant's legal adviser, Djidon Batmomolin, said that his client committed premeditated murder of the victim due to feelings of revenge. The murder occurred in December 2022.
"It is suspected that one of the defendant's family had experienced immoral acts by the victim, but this issue was not legally resolved, so he intended to kill the victim after drinking alcohol together in December 2022," he said.
However, as a result of the defendant's actions, his house was also the target of the residents' tantrums until it was damaged but not legally processed by the security forces.
