Commission I Of The House Of Representatives And The Government Agree That The Revision Of The ITE Law Will Be Brought To The Plenary Session To Be Ratified Into Law

JAKARTA - Commission I of the DPR has agreed that the revision of the Electronic Information and Transaction Law will be brought to a plenary meeting to be ratified into law. The agreement was obtained in a meeting of Commission I of the DPR with the government, in this case the Ministry of Communication and Information and the Ministry of Law and Human Rights at the Parliament Complex, Senayan, Jakarta, Wednesday, November 22. Nine factions agreed that the bill was brought to the plenary session after expressing their opinion regarding the bill on the second amendment to the ITE Law. "All factions have conveyed their final mini views on the Amendment to the ITE Law to then be brought to the discussion of the second level of the DPR RI plenary session to then be approved into law," said Chairman of Commission I of the DPR as chair of the meeting, Meutya Hafid. "We used to knock on this from the DPR, then we invited the Minister of Communication and Information who represented the government to give a mini-government opinion," he continued. Minister of Communication and Information Budi Arie also agreed that the ITE Bill was brought to the plenary session. He hopes that the ratification of the bill will not be carried out for a long time. "The government can approve the script for the second amendment bill to the ITE Law which was mutually agreed upon by Commission I of the DPR RI to be brought to level II in the not too distant future," said Budi Arie. After hearing Budi Arie's opinion, Meutya then asked again regarding the approval to bring the ITE Bill to be ratified in the plenary session. "The government also approved that the bill for the second amendment to the law was brought to level II discussions in a plenary meeting of the DPR RI to be approved into law," said Meutya. "Ladies and gentlemen, members of Commission I of the DPR RI and the government, can we agree on the second amendment to the ITE Law to be brought to level II discussions at the DPR RI Plenary Meeting to be approved into law?" asked Meutya Hafid followed by a statement of agreement and knock on the hammer. Previously, the Chairperson of the ITE Bill Working Committee, Abdul Kharis Almasyhari, explained the subtance of the Bill on Amendments to the 2nd Law on Information and Electronic Transactions (ITE). He said that on April 10, 2023, Commission I together with the government had agreed on 38 DIM.

As for identification of the substance in question, namely: 1. amendments to the provisions of Article 27 Paragraph 1 concerning the content of decency; Paragraph 3 concerning the content of insults and/or defamation; and Paragraph 4 concerning extortion or threats which refers to the provisions of the article in Law Number 1 of 2023 concerning the Criminal Code 2. Changes to the provisions of Article 28 Paragraph 1 regarding information spreading false and misleading news resulting in consumer losses in electronic transactions 3. Changes to the provisions of Article 28 Paragraph 2 regarding spreading false and misleading news, as well as acts that cause hatred or hostility based on SARA 4. Changes to the provisions of Article 29 regarding threats and / or intimidation 5. Changes to the provisions of Article 36 regarding actions that result in losses for others 6. Changes in the provisions of Article 45 related to the threat of imprisonment and criminal fines, as well as adding provisions regarding the exception of the imposition of criminal provisions for violations of decency in Article 27 paragraph 1 7. Changes in the provisions of Article 45a related to criminal threats for acts of spreading false and misleading news.
