Unhealthy Condition, Anwar Usman Did Not Attend Suhartoyo's Inauguration As Chief Justice Of The Constitutional Court

JAKARTA - Former Chief Justice of the Constitutional Court (MK) Anwar Usman was observed not attending a special plenary session with the agenda of inauguration and taking Suhartoyo's constitutional judge oath as Chairman of the Constitutional Court (MK). "I contacted him (Anwar, ed.) earlier, permission to go to the hospital, he was not healthy," said Chief Justice of the Constitutional Court Suhartoyo at the Constitutional Court Building, Jakarta, as reported by Antara, Monday, October 13. The special plenary session with the agenda of taking the oath of the Chief Justice of the Constitutional Court for the term of 2023-2028 was chaired by Deputy Chairman of the Constitutional Court Saldi Isra. The eight Constitutional Court judges who attended were Suhartoyo, Arief Hidayat, Wahiduddin Adams, Manahan MP Sitompul, Daniel Yusmic Pancastaki Foekh, M. Guntur Hamzah, Saldi Isra, and Enny Nurbaningsih. During Suhartoyo's inauguration, the Chairman of the Honorary Council of the Constitutional Court (MKMK) Jimly Asshiddiqie and Chairman of the General Elections Commission (KPU) Hasyim Asy’ari were also present. Suhartoyo was elected as Chief Justice of the Constitutional Court through an election by deliberation and consensus in a closed plenary meeting of judges on Thursday (9/11). In the election and announcement of the elected Chief Justice of the Constitutional Court, Anwar Usman was present along with eight other constitutional judges. Suhartoyo was inaugurated and sworn in based on the Decree of the Constitutional Court of the Republic of Indonesia Number 17 of 2023 concerning the Appointment of the Chief Justice of the Constitutional Court for the Term of Office 2023 — 2028 which was set in Jakarta on November 9, 2023.

Meanwhile, Anwar Usman was dismissed as Chief Justice of the Constitutional Court after the decision of the Honorary Council of the Constitutional Court (MK). Anwar was proven to have committed a serious violation related to the Constitutional Court Decision Number 90/PUU- XXV/2023, the minimum age limit for presidential/cawapres 40 years plus the clause that he served as regional head.
