MKMK Chairman Jimly Asks For A Decision Of The Ethics Session To Be Accepted Even Though He Is Not Satisfied With All Parties

JAKARTA - The Honorary Council of the Constitutional Court (MKMK) read out the verdict on alleged violations of the code of ethics and behavior of constitutional judges against nine constitutional judges.

The Constitutional Court's decision refers to the report on the decision of the Constitutional Court (MK) Number 90/PUU-XXI/2023 which allows regional heads not yet 40 years old to run as presidential and vice presidential candidates.

The decision on the handling of the MKMK case was read out by the Chief Justice of the MKMK and concurrently Member, Jimly Asshiddiqie (community figure), Secretary concurrently Member of the MKMK, Wahiduddin Adams (constitutional judge), and Member of the MKMK, Bintan R. Saragih (law academic).

When opening the verdict hearing, Jimly hoped that all parties could accept the results of the verdict to be read out.

"Hopefully you can accept this later, later, these four decisions. Not all of you are satisfied, right? The court's decision is like that. It does not satisfy all parties," said Jimly at the Constitutional Court building, Central Jakarta, Tuesday, November 7.

Jimly also emphasized that Indonesia, as a state of law, must establish a tradition of respect for the courts and their decisions.

More importantly, Jimly hopes that this decision will bring peace of our political life to the 2024 General Election.

"Therefore, we must not protrude or let ourselves drag on with all kinds of tetek bengek. So, well. Now everyone is focused on making the election a success," he said.

The Constitutional Court received 21 reports of alleged violations of the ethics of the Constitutional Court judge on the Constitutional Court's decision Number 90/PUU-XXI/2023 which allowed regional heads not yet 40 years old to run as presidential and vice presidential candidates. However, in this trial, the reading of the results of case handling is divided into four decisions.

This decision refers to the Constitutional Court Regulation (PMK) Number 1 of 2023 concerning the Honorary Council of the Constitutional Court. In the regulation, there are 3 types of sanctions that can be imposed, verbal warnings, written warnings, or dishonorable dismissals.

Reviewing the case decision Number 90/PUU-XXI/2023 which was read out on Monday, October 16, 2023, the Constitutional Court judges who agreed with the verdict were Anwar Usman who is also the uncle of Gibran Rakabuming Raka, Guntur Hamzah, and Manahan M. P. Sitompul.

Meanwhile, Judge Daniel Yusmic Pancastaki Foekh and Enny Nurbaningsih expressed their opinion or different reasons. Both are of the view that they agree that only governors can run for presidential and vice presidential candidates even though they are not 40 years old.

Then, there was an employee who stated dissenting opinions or different opinions. Saldi Isra and Wahiduddin Adams refused to grant this case. Meanwhile, Suhartoyo and Arief Hidayat stated that the lawsuit should not have been accepted.
