JAKARTA - Chairman of the Honorary Council of the Constitutional Court (MKMK) Jimly Asshiddiqie declared that the constitutional judge and member of the Constitutional Court Wahiduddin Adams was the most free of charges of violating the code of ethics.

"Mr. Wahid is most free from allegations of violation of the code of ethics," said Jimly.

According to him, Wahiduddin is one of the nine constitutional judges who are most free from charges of violating the code of ethics. Therefore Jimly considered Wahiduddin still suitable to be a member of the MKMK.

"That's why he is suitable to be a member of the MKMK," said Jimly as quoted by ANTARA, Thursday, November 2.

The Constitutional Court on Thursday (2/11) examined three constitutional judges who were suspected of violating the code of ethics on the Constitutional Court's Decision Number 90/PUU-XXI/2023, namely Guntur Hamzah, Daniel Yusmic Pancastaki Foekh, and Wahiduddin Adams.

Previously, Jimly Asshiddiqie said that the nine Constitutional Court judges had the potential to violate the code of ethics because they allowed the institution to decide cases allegedly related to the interests of members of the judge's family.

"So, the nine judges of the Constitutional Court were accused of all violating (the code of ethics) for allowing it. So, we ask one by one, yes, each has a reason," said Jimly at Building II of the Constitutional Court, Jakarta, Wednesday (1/11).

If the Constitutional Court judge is proven to have violated the code of ethics, said Jimly, then the MKMK can also be convinced to cancel the Case Decision Number 90/PUU-XXI/2023 regarding the change in terms of being a presidential and vice presidential candidate.

"This means that according to the Law on Judicial Power Article 17 paragraph 7, (the case) is discussed by the Judge's Consultative Meeting (RPH) again by different assemblies," he said.

In this case, the MKMK emphasized that it would accelerate the decision on reports of alleged violations of the code of ethics of nine constitutional judges on November 7 before the final opportunity to propose changes to the presidential/vice-presidential candidate pairs.
