JAKARTA - The Constitutional Court (MK) held a trial with a preliminary examination agenda to hear the main requests of the three judicial review cases of Law Number 7 of 2017 concerning General Elections (UU Pemilu), regarding the conditions for the age of nomination of presidential and vice presidential candidates.

"Our agenda is to listen to the main points of the petition from each party," said Constitutional Justice Saldi Isra, starting the trial at the Constitutional Court building, Jakarta, as reported by ANTARA, Thursday, September 7.

The three cases are Case Number 91/PUU-XXI/2023, 93/PUU-XXI/2023, and 96/PUU-XXI/2023. All three submitted requests for judicial review of Article 169 letter q of the Election Law, with different main applications.

The article 169 letter q of the Election Law requested for judicial review by the petitioners reads: "The requirement to become a presidential candidate and a vice presidential candidate is at least 40 years old".

The case of 91/PUU-XXI/2023 submitted by the Sebelas Maret University (UNS) Law student Arkaan Wahyu Re A, basically asked for the presidential-cawapres age limit to be lowered to at least 21 years.

Arkaan's attorney, Ilyas Satria Agung argued that a 21-year-old with the experience of leading at the regional level, is better than a 40-year-old person who has never had a leadership experience at all.

"That like an example in Solo or in Surakarta, Gibran Rakabuming is now viral because the progress of the city he leads. Show or set an example if young leaders can be well and trustworthy in leading the government," said Ilyas.

In line with this case, Case Number 93/PUU-XXI/2023 also asked for the age limit for presidential and vice-presidential candidates to be reduced to a minimum of 21 years. The case was filed by an Indonesian citizen named Guy Rangga Boro.

"The provisions of Article 169 letter q of Law Number 7 of 2017 for applicants who are under 40 years old certainly do not get recognition of guarantees of fair protection and legal certainty and equal treatment before the law," said Guy Rangga reading out the main points of his petition.

Meanwhile, the 96/PUU-XXI/2023 case with the applicant for an Indonesian citizen named Riko Andi Sinaga, asked the court to change the phrase 'lowest 40 years old' in Article 169 letter q of the Election Law to 'lowest 25 years old'.

"In fact, the applicant in carrying out his legal rights, namely to nominate himself as vice president, cannot be carried out because discriminatoryly, the object of the petition has limited the applicant's rights because the vice presidential candidate is at least 40 years old," said Riko Andi's attorney, Purgatorio Siahaan.
