Prosecutors Demand Former Director Of Praya Muzakir Hospital To Be Absent For 7.5 Years In Prison And A Fine Of IDR 500 Million

The prosecutor demanded that the panel of judges impose a sentence on the former Director of the Praya Regional General Hospital (RSUD), Central Lombok Regency, Muzakir Langkir for 7.5 years in prison. Muzakir Langkir was involved in the corruption case of funds from the Regional Public Service Agency (BLUD) from 2017 to 2020. "Demanding that the panel of judges impose a sentence on the defendant Muzakir Langkir for 7 years and 6 months in prison," said Surya Diatmika representing the team of public prosecutors in the trial of the defendant Muzakir Langkir's demands at the Corruption Court at the Mataram District Court, quoted from Antara, Friday, June 23. The prosecutor also asked the panel of judges to impose a fine for the defendant in the amount of Rp. 500 million, subsidiary to 6 months in prison. The prosecutor in charge of charging the defendant to pay compensation for state losses amounting to Rp536 million, which is the result of reducing the return from the defendant and three project implementing partners with a value of Rp347 million from the total loss of Rp883 million. If the defendant is unable to pay within a period of 1 month from the time the decision has permanent legal force, said the prosecutor, his party will confiscate and auction off the defendant's property to cover the replacement money. "If the defendant's property is not sufficient to replace it, the defendant is obliged to serve a sentence of 2 years and 9 months in prison," said the prosecutor. The demand to pay the replacement money refers to the indictment of the prosecutor who stated that the defendant was proven to have violated Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code. The prosecutor also charged an additional replacement money of Rp. 862.6 million, subsidiary to 6 months in prison. This value is the result of a reduction from the return of witnesses Baiq Prapningdiah and Siti Zubaidah as much as Rp. 14.4 million from the value of bribes and / or gratuities of the defendant amounting to Rp.877 million. The demand to pay the additional replacement money refers to the proof of Article 11 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) of the 1st Criminal Code. The prosecutor read out the charges on the grounds that the defendant did not support the government's efforts to eradicate corruption and the defendant's actions had harmed the community. "The mitigating thing is that the defendant has never served a sentence, the defendant admits his actions, the defendant has shown good faith by recovering some state losses worth Rp. 50 million, and the defendant was polite during the trial," he said. In the description of the charges, the public prosecutor also explained the role of Muzakir Langkir who was responsible for the emergence of state losses of Rp.883 million. Muzakir Langkir as the power user of the budget in managing BLUD funds at the Praya Hospital ordered the second defendant, Adi Sasmita, as the official commitment to determine a number of provider companies that can get goods and services procurement projects. Muzakir Langkir also ordered another defendant, Baiq Prapningdiah Asmarini, in his capacity as the Regional Expenditure Treasurer at the Praya Hospital to cut the payment of the work that had been done by the provider. This is corroborated by the results of an audit expert who found state losses in a number of work in the procurement of goods and services for the 2017 to 2020 period worth Rp883 million.

The public prosecutor said that the number of losses arose in the procurement of wet and dry foods based on the report on the results of the Central Lombok Inspectorate audit.
