The Constitutional Court Calls The 2024 Election System RPH Not Yet Carried Out And A New Conclusion Handed Over May 31

Spokesperson for the Constitutional Court (MK) Fajar Laksono said the Hakim Consultative Meeting (RPH) related to the case with Registration Number 114/PUU-XX/2022 had not yet been held. Based on the last trial on Wednesday 30 May and the submission of conclusions to the panel of constitutional judges on 31 May 2023.

The Constitutional Court is currently discussing the appropriate steps regarding the alleged leak of information on the 2024 election system decision.

"Yes, of course we have read, we have looked at today's considerations. It is not impossible that steps will be taken. But what is certain is that it will be discussed internally first. What steps should be taken by the Constitutional Court," Fajar said as quoted by ANTARA, Monday, May 29.

Fajar did not confirm whether the Constitutional Court would examine former Deputy Minister of Law and Human Rights (Wamenkumham) Denny Indrayana who claimed to have received information about the Constitutional Court's decision regarding the upcoming election system.

"Yes, we don't know yet (checking Denny Indrayana or not). We are still discussing it internally first, what are the right steps, with developments, with news like that," he said.

However, Fajar explained that the Hakim Consultative Meeting (RPH) related to the case with Registration Number 114/PUU-XX/2022 had not yet been held. Based on the last trial on Wednesday 30 May and the announcement of conclusions to the constitutional panel of judges on 31 May 2023.

"That means there has been no discussion because after the submission of the new conclusion it will be discussed. It will only be discussed. After it is finished, a decision is made, then the verdict is 'drafting', the decision is ready, so a trial is scheduled immediately," he explained.

Therefore, Fajar denied the alleged leak of information regarding the case.

"Well, how could it be leaked or what if it has not been discussed. Please ask the party concerned," said Fajar.

Previously, former Deputy Minister of Law and Human Rights Denny Indrayana claimed to have received information about the Constitutional Court's decision regarding the legislative election system which would return to a closed proportional system or party voting.

"This morning I received important information. The Constitutional Court will decide on the legislative election to return to a closed proportional system, again choosing a party image mark," Denny said via a tweet on his Twitter account @dennyindranaya, Sunday.

In his tweet, Denny also mentioned the source in the Constitutional Court. Although he did not answer clearly, Denny confirmed that the source was not a constitutional judge.

"Who is the source? The person I really trust is credibility, who is definitely not a Constitutional Judge," he said.

Meanwhile, the Constitutional Court has received a request for a judicial review of Article 168 paragraph (2) of the Election Law related to an open proportional system registered with Case Registration Number 114/PUU-XX/2022 on November 14, 2022.

The six applicants are Demas Brian Wicaksono (Permohon I), Yuwono Pintadi (Pemohon II), Fahrurrozi (Pemohon III), Ibnu Rachman Jaya (Permohon IV), Riyanto (Pemohon V), and Nono Marijono (Pemohon VI).
