Allegedly Disposal Of Waste Into The Malili River, PT CLM Version Zainal Abidin Can Be Criminally Charged

JAKARTA - Dozens of people who are members of the Youth and Community Alliance Malili held a demonstration in front of the East Luwu Regency DPRD office protesting against the pollution of the Malili River allegedly carried out by PT CLM which is now controlled by Zainal Abidin Siregar on Friday, April 28.

The mass coordinator, Malik, said the action was carried out because the current condition of the Malili River water was cloudy and no longer as clear as it used to be.

"The water is cloudy and can no longer be used for washing and drinking," Malik said in Jakarta, Saturday, April 29.

As is known, the chaotic share ownership of PT CLM also dragged the name of Wamenkumham, which has now been reported by IPW to the Corruption Eradication Commission.

According to him, the government must summon all mining companies to explain where their waste was disposed of and if it can be socialized to the public.

"This action is also only as a lighter and there is a plan for further action," he said.

Meanwhile, the National Coordinating Board for the Islamic Student Legal Consultation and Aid Institute (Bakornas LKBHMI) PB HMI, previously reported PT CLM to the Directorate General of Law Enforcement of the Ministry of Environment and Forestry (Ditjen Gakkum KLHK).

Deputy Executive Director of Bakornas LKBHMI PB HMI, Ibrahim Asnawi said that the report was related to allegations of permit and pollution and/or environmental destruction due to PT CLM's nickel mining activities operating in Malili District, East Luwu Regency, South Sulawesi Province.

"We have an obligation to protect and preserve our environment. Everyone has the right to get a good and healthy environment, it is a human right guaranteed in Article 28 H Paragraph (1) of the 1945 Constitution of the Republic of Indonesia. We hope that the Ministry of Environment and Forestry will follow up on this report," said Ibrahim.

Bakornas LKBHMI PB HMI pun mendesak Gakkum KLHK untuk melakukan penegakan hukum secara serius dan komprehensif untuk menindak tegas dugaan adanya kerusakan lingkungan yang diakibatkan oleh aktivitas penambangan nikel PT CLM.

According to him, PT CLM under the control of Zainal Abidin Siregar can be criminally charged and administrative sanctions as regulated in Law Number 32 of 2009 concerning Environmental Protection and Management (UU PPLH) as well as in Law Number 19 of 2004 concerning Forestry.

Separately, the National Police Commission (Kompolnas) asked people who feel they do not receive services from the East Luwu Police, to report to his side and Itwasda Polda South Sulawesi.

This was stated by the Commissioner of Kompolnas Poengky Indarti in response to the alleged East Luwu Police who did not process public reports regarding the alleged pollution of the Malili River, East Luwu Regency, South Sulawesi by mining companies.

"Please, victims who feel they do not get good service from the Luwu Police to report to the South Sulawesi Regional Police Itwasda as the internal supervisor of the National Police and to Kompolnas as the functional supervisor of the National Police," said Poengky.

According to him, Kompolnas will follow up after his party gets the complaint and clarifies the South Sulawesi Regional Police.

"If we have received the complaint, we will immediately follow up with clarification to the South Sulawesi Regional Police," he said.

Similarly, Police Observer Bambang Rukminto assessed that if the reporting party had brought sufficient evidence but not processed, Bambang asked the reporter to complain to the South Sulawesi Regional Police's Bid Propam to Kompolnas.

"If the reporter has brought strong evidence, and the Resort Police will not immediately follow up, just report it to the Wasidik or BidPropam Polda, the copy can be to the National Police Chief and Kompolnas," said Bambang.
