BNN Rejects Legalization Of Marijuana, Affirms Narcotics Category 1 Is Not Allowed For Drug Purposes

JAKARTA - The National Narcotics Agency (BNN) expressly reject the legalization of marijuana because based on Law No. 35 of 2009 concerning Narcotics, the abuse of marijuana types is completely prohibited in Indonesia.

"We are a state of law, meaning that we enforce positive laws. If the positive law regarding narcotics regulation is in Law Number 35 of 2009 which states that narcotics group 1 is not allowed for medicinal purposes, and marijuana is included in group 1 then in the process of law enforcement and positive law is impossible to legalize", said the Director of Law/Plt. BNN Deputy for Legal Affairs and Cooperation Susanto was reported by ANTARA, Tuesday, July 5.

However, Susanto said that the use of marijuana compounds could be regulated in regulation, not legalization.

In the FGD with the theme of the Bill on the second amendment to Law Number 35 of 2009, the Dean of the Faculty of Law at the Catholic University of Indonesia Atma Jaya, Asmin Fransiska, asked all parties to be careful in the word legalization, considering that in general narcotics policy there are stages.

The first stage is the criminalization that is currently happening in Indonesia. The second is decriminalization, which issues aspects of punishment for narcotics users for their own benefit or others in a certain capacity.

The next stage is regulation. Many countries control the use of excessive (overused), or a kind of euphoria during the legalization of narcotics, through regulations.

"What are the regulations like? For the use of medical marijuana, it is only allowed to carry out laboratory tests first, apply for permits, create certain pharmacies, and are intended for certain patients", said Asmin Fransiska.

In this case, the terminology is no longer used by narcotics users, but by patients. Then it is only allowed in certain places, as is done by the Netherlands and Spain.

The legal observer also said that countries such as the Netherlands and Spain carried out regulations in these ways. Even if Thailand legalized marijuana for medical use, he was very sure that Thailand had certain regulations to regulate this.

"Discussions regarding this regulation seem to be missing, we are always polarized into two poles, namely between the poles of criminalizing marijuana and the poles of legalizing marijuana. We forget that there is another stage, namely entering the issue of decriminalization for narcotics users, and secondly, we will test the abilities of the government and the state in carrying out regulations. This lies in the balance between the Ministry of Health and law enforcement", said Asmin Fransiska.
