LBH Jakarta Values Arbitrary Determination Of Six Holywings Employee Suspects

JAKARTA - The Jakarta Legal Aid Institute (LBH) said that the police had determined the six Holywings employees in the case of promoting alcohol to people named Muhammad and Maria by the police to be arbitrary.

The Holywings workers were charged with Article 14 paragraph 1 and paragraph 2 of the Republic of Indonesia Law Number 1 of 1946 and also Article 156 or Article 156A of the Criminal Code, then Article 28 paragraph 2 of Law Number 19 of 2016, namely amendments to Law 11 of 2008 or the ITE Law. LBH lawyer Muhammad Fadhil Alfathan considered this allegation to be incorrect.

"LBH Jakarta considers that the application of the articles to designate 6 Holywings employees as suspects is inappropriate. The imposition of these articles is more because the articles are rubber. This then strengthens the allegation that law enforcement, in this case, is a criminalization or forced punishment," said Fadhil in his statement, Tuesday, June 28.

Then, Fadhil saw that there were a series of violations of the criminal procedure law in handling this case. Of which, 6 Holywings employees have been arrested since they were witnesses and before being named suspects.

In addition, Fadhil also regretted the attitude of the management of Holywings Group, which in fact ensured that 6 of its employees who were designated as suspects received strict sanctions.

In fact, as an employer, Holywings must not only emphasize the sanctions that will be imposed, but must still fulfill the rights of the 6 Workers/Labourers.

"Based on Article 53 paragraph (1) of PP 35/2021, the 6 workers are entitled to assistance to the families of the workers/laborers who are their dependents in the event that they are being detained by the authorities because they are suspected of committing a crime," said Fadhil.

Therefore, Fadhil urged the National Police Chief General Listyo Sigit Prabowo to order the South Jakarta Metro Police Chief to immediately stop investigating the case that ensnared 6 Holywings workers.

"LBH Jakarta also urges the National Police Chief and his staff to evaluate and impose strict sanctions on members of the South Jakarta Metro Police who investigated this case unprofessionally by violating the Criminal Procedure Code," he said.
