KPK Prevents Inactive Mimika Regent Eltinus Omaleng From Going Abroad
JAKARTA - The Corruption Eradication Commission (KPK) has prevented the inactive Mimika Regent Eltinus Omaleng from leaving the country until January 2024.
Head of the KPK News Section Ali Fikri said the implementation of the prevention of Eltinus was carried out for investigation purposes.
"On the basis of developing cases related to allegations of corruption in the construction of the Kingmi Mile 32 Church in Mimika Regency, the KPK has submitted prevention to the Director General of Immigration at the Ministry of Law and Human Rights of the Republic of Indonesia against Eltinus Omaleng in his position as a witness," Ali said as quoted by ANTARA, Monday, August 21.
Ali explained that the implementation of prevention was valid for six months or until January 2024, while reminding the person concerned to cooperate with KPK investigators.
"We remind the witness to cooperate in dealing with the investigation team as scheduled for the summons to be sent immediately," he said.
The KPK prosecutor team on Thursday (10/8) submitted a memorandum of cassation against Eltinus Omaleng's release in the alleged corruption case related to the Kingmi Mile 32 Church construction project.
"The KPK Prosecutor's Team has submitted a memorandum of cassation for the case of Defendant Eltinus Omaleng through the Corruption Court at the Makassar District Court," Ali said when confirmed in Jakarta, Thursday (10/8).
VOIR éGALEMENT:
Ali explained that in the cassation memory, the KPK Prosecutor's Team argued that the Panel of Judges who tried the case, when reading the verdict which was open to the public at that time, did not read it and elaborate on legal considerations containing the reasons and articles of laws and regulations which became the main basis of the decision.
The action of the Panel of Judges, which only read out the verdict, contradicts the provisions stipulated in Article 195 and Article 199 paragraph (1) letter b of the Criminal Procedure Code.
In addition, the basis of the decision also does not contain the slightest reason and consideration of the Panel of Judges who decide that the Defendant is free from all lawsuits.
The consideration of the decision of the Panel of Judges is also not appropriate and contrary to the legal facts revealed by the KPK Prosecutor's Team during the trial process.
In the trial, as evidence presented by the KPK Prosecutor Team clearly explained the defendant's actions, which were with orders and known and wanted to corrupt the construction of the Kingmi Mile 32 Church which resulted in state financial losses.
The KPK hopes that the Panel of Judges at the Supreme Court of the Republic of Indonesia can decide and grant the cassation request of the Prosecutor's Team as stated in the indictment by declaring guilty and being sentenced to 9 years in prison accompanied by paying compensation of IDR 2.5 billion and additional penalties in the form of revocation of the right to be elected in public office.
