Johnny Plate's Exception Is Not Based, Prosecutors Ask Judges To Continue Trial
JAKARTA - The Public Prosecutor (JPU) asked the panel of judges to reject the exception or objection note submitted by the former Minister of Communication and Information (Menkominfo) Johnny G Plate.
The panel of judges was asked to continue the trial to prove the alleged corruption in the provision of 4G Base Transceiver Station (BTS) infrastructure for the 2020-2022 period.
"The legal administration of the legal advisor as the reason for the objection above is not true and not based on law. We ask the panel of judges who examine and try this case to continue the trial with the agenda of examining the subject matter of the case," said the prosecutor during a trial at the Corruption Court at the Central Jakarta District Court, Tuesday, July 11.
The indictment prepared by the prosecutor has described carefully, clearly and completely the elements, time, and place of the crime. Therefore, the indictment is considered to meet the material requirements as stipulated in Article 143 paragraph 2 letter b of the Criminal Procedure Code.
"Furthermore, the public prosecutor has also explained all the elements of the offense formulated in the charged criminal article, how the crime was committed and mentioned the conditions attached to criminal acts," he said.
In addition, the exception submitted by legal advisor Johnny G Plate is considered to have entered the subject matter of the case. Thus, it must be tested in the process of proof.
"Thus, the reason for the objection or exception of the defendant's legal advisor is baseless and must be ruled out or not accepted," said the prosecutor.
