Panel Of Judges Rejects Lukas Enembe's Exception
JAKARTA - The panel of judges rejected the objection note (exception) from the Governor of Papua for the period 2013-2018 and 2018-2023 Lukas Enembe in the case of alleged receipt of bribes and gratuities and ordered the trial to continue with the agenda of examining witnesses."The trial stated that the defendant's memorandum of objection or exception, Lukas Enembe and the defendant's legal adviser, could not be accepted," said Chief Justice Rianto Adam Pontoh reading the interlocutory verdict at the Jakarta Corruption Court (Tipikor), Antara, Monday, June 26.The panel of judges also assessed that the indictment of the KPK Public Prosecutor (JPU) had met the formal and material requirements and ordered it to proceed to the evidentiary stage."Ordered the public prosecutor to continue examining corruption cases on behalf of the defendant Lukas Enembe," added the judge.In their consideration, the panel of judges considered that Lukas Enembe's objection had no legal basis so that the objection note could not be accepted."The preparation and form of the indictment are not determined, the authority of the public prosecutor. The defendant's assessment is related to the quality of the witnesses, even though the panel of judges has never examined the witnesses so that they cannot be accepted," said the judge.The panel of judges also ordered the detention of Lukas Enembe to be delivered for 2 weeks on health grounds."Determining, one grants the request of the defendant and the legal advisory team, the second orders the public prosecutor at the KPK to carry out an argument against the detention of the defendant Lukas Enembe from June 26, 2023 to July 9, 2023," said the judge.This was decided by the judge because the team of legal advisers, Lukas Enembe, brought the results of laboratory examinations from the Gatot Subroto Army Hospital."In order to maintain and guarantee the defendant's health during the examination at the trial, the panel of judges is of the opinion that the defendant's request is reasonable enough to be granted," added the judge.In this case, Lukas Enembe was charged with two charges.First, Lukas was charged with accepting bribes from Rp45,843,485,350 with details of Rp10,413,929,500 from businessman Piton Enumbi as Director and owner of PT Meonesia Mulia, PT Lingge-Lingge, PT Astrad Jaya and PT Melonesia Cahaya Timur and as much as Rp35,429,555,850 from Rijatono Lakka as Director of PT Tabi Anugerah Pharmindo, PT Tabi Bangun Papua as well as CV Walibhu.The second indictment, Lukas Enembe was also charged with receiving gratuities in the form of Rp1 billion from Budy Sultan as Director of PT Indo Papua on April 12, 2013.
Rijatono Lakka has also been sentenced to 5 years in prison by the Jakarta Corruption Court. Recently, the KPK has again named Lukas Enembe as a suspect in the alleged crime of money laundering (TPPU). The KPK has confiscated a number of assets related to the Lukas Enembe case in various forms with a total value of more than Rp200 billion.
