Bharada E Sentenced To 1 Year 6 Months, Legal Experts Value Is Right

JAKARTA - A criminal law expert from Brawijaya University, Aan Eko Widiarto, assessed that the 1 year and 6 months prison sentence handed down to Richard Eliezer or Bharada E was correct.

The Panel of Judges at the South Jakarta District Court (PN) is considered to be still considering the sentence.

"In my opinion, this is correct. The judge has considered that E is the perpetrator, so he is still being punished," Aan told VOI, Wednesday, February 15.

By imposing this sentence, it is considered that the deterrent effect will still be felt by Richard. However, on the other hand, the judge still pays attention to the status of the justice collaborator (JC) or witnesses who work together.

"So (Bharada E, red) was given a low penalty," he said.

Richard was sentenced to 1 year and 6 months in prison because he was found guilty and involved in a series of premeditated murder cases against Yosua Nopriansyah alias Brigadier J. He was found guilty of violating Article 340 of the Criminal Code junto Article 55 Paragraph 1 to (1) of the Criminal Code.

"Sentenced a sentence against the defendant with imprisonment for 1 year and 6 months," said Chief Judge Wahyu Iman Santoso during the trial at the South Jakarta District Court, Wednesday, February 15.

The panel of judges was of the opinion that actually Bharada E had the opportunity to prevent Joshua or Brigadier J from being killed in a series of premeditated killings. For example, during the execution process, he could aim his shots at Brigadier J's body which was not a vital part.

However, the accused did not do that. Bharada E instead fired his Glock-17 firearm at Brigadier J's left chest. That area is everyone's vital area because it is where the heart is.

In this case, the panel of judges has also sentenced the former Head of Prompam Polri Ferdy Sambo, and his wife, Putri Candrawathi; Kuat Ma'ruf; and Ricky Rizal. Ferdy Sambo was sentenced to death. Meanwhile, Putri Candrawathi was sentenced to 20 years in prison.

Then, the panel of judges imposed a prison sentence of 15 years for Kuat Ma'ruf. Meanwhile, Ricky Rizal was sentenced to 13 years in prison.
