Regarding Handling The Law On Disruption Tragedy, Mahfud MD: If I Want To Legally Die Aja, But There Is No Reason
JAKARTA - Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam) Mahfud MD admitted that he had complaints from survivors and the families of the victims were dissatisfied with the legal handling of the Kanguhan Tragedy.
Mahfud said that many parties were not satisfied with the process of resolving the incident after the Arema FC vs Persebaya match in Surabaya on Saturday, October 1 that night.
"Yesterday I just received the victim's family who complained that they were not satisfied with the handling, so no one was satisfied. The police are also not satisfied, we are also dissatisfied," Mahfud told reporters at his office, Central Jakarta, Sunday, January 8.
As Chair of the Joint Team for Independent Fact Findings (TGIPF) of the Kanjuruhan Tragedy, Mahfud explained that the crimes that occurred in the Impact Tragedy took place quickly.
"So it is difficult or not easy to track. Meanwhile, law enforcement must be careful to follow the rules of the law so as not to violate human rights, that's the problem," said Mahfud.
The families of victims of the Kanjuruhan Tragedy met Mahfud MD together with representatives of the Witness and Victim Protection Agency (LPSK) at the Office of the Coordinating Ministry for Political, Legal and Security Affairs, on Friday, January 6. Their goal is to ask for justice for the tragedy that killed 135 people.
Regarding survivors and the victim's family who requested that the Kanjuruhan Tragedy suspects be subject to Article 338 and Article 340 of the Criminal Code regarding premeditated murder with the threat of the death penalty, Mahfud responded that it needed an investigation process to a long investigation.
"This is a matter of law, it's about elements, it's not about bargaining on articles like that. If you want me, just let it go, 135 people, right? But there's no article to declare that," he said.
Including the question of categorizing the Pelanggran HAM whether it is heavy or not, Mahfud admitted that he did not have the power to decide on this.
"But it wasn't me, it wasn't me who asked for it, and determined the article. There were elements in the examination. It's the same, someone shouted it was a gross human rights violation, no. The gross human rights violation can only be decided by Komnas HAM," he said.
