YOGYAKARTA An investigation conducted by the National Human Rights Commission (Komnas HAM) on the Flood Tragedy in Malang, East Java adds new information. The release was delivered through a press conference on Wednesday, October 2 at noon.

In the investigation, Komnas HAM took steps to monitor and investigate, one of which was by asking witnesses and victims who knew about the incident. Here are some factual findings obtained by Komnas HAM.

Malang Police Chief asked Panpel Arema FC to change the schedule for the 2022 BRI Liga 1 football match to PT PT Liga regarding the plan for a soccer match between Arema FC and Persebaya.

The President Director of PT Liga Indonesia conveyed to the management of the Arema FC club who asked to continue to carry out matches according to a predetermined schedule. Because the request for a schedule was not approved, the Malang Police Chief asked for additional security from both the Police and the TNI, which were originally 1,700 personnel, to 2,034 personnel.

"This means additional from the police and the TNI," said Beka Ulung Hapsara, Commissioner of the National Human Rights Commission.

In security efforts, the Police took anticipatory steps for 10 days, from September 20 to September 30, 2022. One of them was carrying out a corvey at the Kanjuruhan Stadium. The police chief asked for broken goods and stones to be cleaned to minimize throwing in the stadium.

In addition, the Police Chief also asked Dalmas to practice all kinds of simulation scenarios for all situations, including in the environment and in the Kanjuruhan Stadium.

Komnas HAM said that the commissioner match did not check the security plan and only checked the condition of the stadium.

The shooting of tear gas in the Kanjuruhan Stadium was not only carried out by Brimob but also by Sabara personnel. The type of weapon that emits Brimob's tear gas is a long slippery barrel. Meanwhile, the tear gas ammunition used is stock in 2019 and has expired or expired.

Match Commissioners are aware of the use of tear gas but did not report it. They also stated that they did not know that the use of tear gas was prohibited in football matches.

Komnas HAM also stated that the Brimob troops deployed were troops with PHH capabilities or riot troops using tear gas. In security, the shooting of tear gas was carried out without coordination with the Malang Police Chief and over discretion or freedom of decision in every situation faced by troops.

From the Komnas HAM investigation, it is estimated that tear gas was fired inside the stadium in the Kanjuruhan Tragedy 45 times with details of 27 gunshots visible from the video, and 18 others confirmed by gunshot.

Komnas HAM stated that there was violence perpetrated by officers against civil society which became supporters. Violence in the form of beatings, beatings, and withdrawals, beatings with sticks.

Based on the information, several stadium exits that were in good condition when supporters came out were doors 1, 2, 4, 5, 6, 8, 11, and 14. Meanwhile, the doors that were in a dense condition that caused the audience to be flanked were doors 3, 7, 9, 10, and 13.

One of the Brimo members fired tear gas at the stands, but one of the ammunition fell and exploded on the left side of door 13, causing panic and forcing people to exit through door 13.

Komnas HAM found violations of FIFA and PSSI regulations in the cooperation agreement between PSSI and the National Police. PSSI as the initiator of cooperation with the National Police did not explain the FIFA rules specifically, including the issue of prohibiting the use of tear gas.

The last stadium verification was carried out on February 6, 2020 by PT LIB. As a result, the Kanjuruhan Stadium does not have a stadium certificate, evacuation plans, ground rules, and field availability letters.

Meanwhile, inspection activities carried out by Match Commissioner on stadiums are more in terms of medical rooms, press convergence rooms, VIP stands, media rooms, field lighting lights, field conditions that must comply with football rules standards.

Several other supports, especially in the economic stands, were not carried out because they were not components in the report form.

The police chief gave a letter of application addressed to several parties to officially advance the match to 15.30 WIB with security considerations.

Then PT LIB discussed with Indoesiar regarding the request for changes to the match schedule. However, Indosiar said that his party conveyed his difficulties and expressed the potential for sponsorship loss.

The police chief then received a letter from PT LIB asking Arema FC to coordinate with the security forces, especially the Malang Police Chief, to continue to carry out matches according to a predetermined schedule. The police chief was finally forced to prepare security because there was no change in the match schedule.

There is a difference in information regarding the capacity of the stadium. The stadium capacity is 38,054 people. Meanwhile, based on Arema and Panpel management, the audience capacity is 45,000 people. Meanwhile, tickets that were successfully sold were 42,516 thousand ticket tickets. This means that there is a difference in information on the capacity of the Kanjuruhan Stadium between official documents and statements from Arema and Panpel management.

PSSI is said to have violated conflicting regulations from PSSI and FIFA regulations such as the involvement of PHH Brimob and its equipment, including the use of tear gas.

In addition, the match was not set as a high-risk match. There is also no high-risk match mechanism, and no security and safety officer certification. These points are points from PSSI regulations but are violated by PSSI itself.
