Kemenkumham Asked To Reject Baim Wong's Claim About Citayam Fashion Week, Musni Umar: He Has No Legality To Patent CFW

JAKARTA - The Chancellor of Ibnu Chaldun University, Musni Umar, assessed that the Ministry of Law and Human Rights (Kemenkumham) has legitimately rejected the registration of the Citayam Fashion Week or CFW brand by artist Baim Wong and his wife, Paula Verhoeven.

"The Minister of Justice and Human Rights of the Republic of Indonesia should refuse registration for Citayam Fashion Week," said Musni Umar through his Twitter account, @musniumar, Monday, July 25.

Baim and Paula through PT. Tiger Wong Entertainment registered CFW as an Intellectual Property Rights or IPR. Intellectual Property Rights are generally registered by individuals or groups on the basis of patenting the work that has been created.

Musni said the Ministry of Law and Human Rights through the Directorate General of Intellectual Property (DJKI) should not just accept the IPR application against CFW. According to him, those who have registered CFW as a trademark do not have a strong legal principle.

"He does not have the legality to register a CFW. The reasons given are also incorrect," he said.

Previously, CFW was registered with DKJI as a trademark by PT. Tiger Wong Entertainment and Indigo Aditya Nugroho.

PT. Tiger Wong registers for the types of entertainment services in the nature of fashion shows, entertainment services, namely providing podcasts in the field of fashion, to the publication of fashion magazines for entertainment purposes.

Meanwhile, Indigo Aditya Nugroho registered for the services of the contest election (entertainment), expo on arts, culture, and education.

Furthermore, fashion shows (entertainment), party planning (entertainment) for promotional events in connection with fashion shows, and live stage performances.

Agung explained that DJKI received the two applications for registration on July 21, 2022. If both applications have entered the publication period, all parties can file an objection to the application for registration of the mark.

After the publication period, the two brands will still go through several stages until they are officially registered. Later, the right to give the mark is the trademark examiner after the inspection process.

"Based on Law Number 20 of 2016 concerning Marks and Geographical Indications, trademark registration needs to go through several stages, starting from a trademark application, formality inspection, announcement (2 months), substantive examination (150 working days), registered and then certificate issuance," he concluded. .
