Jakarta Prosecutor's Office Names Suspect In Land Acquisition Case In Cipayung

JAKARTA - The DKI Jakarta High Prosecutor's Office has named a suspect in the land acquisition case in Cipayung, East Jakarta, which used the DKI Jakarta Parks and Forest Service budget.

Head of the Legal Information Section (Kasipenkum) of the DKI Jakarta High Prosecutor's Office, Ashari Syam, said that in this case, two suspects were named on June 13.

"The two suspects are respectively LD as a notary based on the Suspect Determination Letter Number: TAP-58/M.1/Fd.1/06/2022, and MTT as the Setu Cipayung Land Procurement mafia based on the Suspect Determination Letter Number: TAP-59 /M.1/Fd.1/06/2022," said Ashari as reported by Antara, Tuesday, June 14.

Ashari explained based on an investigation conducted by the DKI Jakarta Attorney General's Office that in 2018, the DKI Jakarta Parks and Forestry Service acquired land in Setu Village, Cipayung District, East Jakarta for eight land owners for the purpose of developing Green Open Space (RTH) for the DKI Jakarta Provincial Government.

In the implementation of land acquisition at the RT 008 RW 003 location, there was no land acquisition planning document, then there was no map of information on the city plan from the City Planning Service, then there was no request for asset information to the Regional Asset Management Agency (BPAD), and there was no approval. from the Governor of DKI Jakarta Province.

"From the results of the investigation, in the land acquisition process there was cooperation between the suspect LD, the suspect MTT and other parties so that the land in Setu Village, Cipayung District can be freed by the DKI Jakarta Parks and Forestry Service," he said.

Then, the suspect LD, together with other parties, have arranged and/or set prices for eight owners of nine plots of land in Setu Village, Cipayung District, East Jakarta.

The land owner should only receive compensation for land acquisition of Rp. 1.6 million per square meter, but based on the role of each suspect, the Forestry Service and DKI Jakarta Province finally spent an average of Rp. 2.7 million per square meter.

"The total money paid by the DKI Provincial Forestry Service was Rp. 46,499,550,000. While the total money received by the land owner was only Rp. 28,729,340,317, so the remaining money from land acquisition enjoyed by the suspects and other parties amounted to Rp. 17,770,209. .683," he said.

Ashari explained, the money was then distributed to a number of parties, including the DKI Jakarta Provincial Forestry Service and other parties through the suspect MTT.

In the process of land acquisition in Setu Village, Cipayung District, East Jakarta, he continued, he violated the provisions of Article 45, Article 55 of Governor Regulation Number 82 of 2017 concerning Guidelines for land acquisition for development in the public interest related to the procurement plan.

Articles that are suspected for the suspect LD are Article 2 paragraph (1), Article 3, Article 5 paragraph (1), Article 13 in conjunction with Article 18 paragraph (1) letter b of the Law on the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) to -1 of the Criminal Code.

Meanwhile, the articles that are suspected for the MTT suspect are Article 2 paragraph (1), Article 3, Article 11, Article 12 letter b in conjunction with Article 18 paragraph (1) letter b of the Law on the Eradication of Criminal Acts of Corruption. Article 55 paragraph (1) 1 of the Criminal Code.
