Proven Corruption, Former Director Of PTPN XI Sentenced To 5.5 Years In Prison

SURABAYA - The Surabaya Corruption Court judges sentenced former Production Director of PT Perkebunan Nusantara (PTPN) XI, Budi Adi Prabowo, to 5.5 years in prison. He was proven guilty of corruption in the procurement and installation of a six-roll mill at the PTPN XI Djatiroto Sugar Factory for the 2015-2016 period.

Chairman of the Panel of Judges, Marper Pandiangan, said that the defendant Budi was legally and convincingly proven to have committed a criminal act of corruption as stated in the prosecutor's indictment, namely Article 2 Paragraph (1) of the Law on the Eradication of Criminal Acts of Corruption in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code.

"We have determined that the defendant is legally and convincingly guilty of committing a criminal act of corruption as stated in the indictment of the public prosecutor", said Judge Marper, while reading the verdict at the Surabaya Corruption Court, Monday, May 30.

In the decision, the judge considered several things that were considered aggravating and mitigating the defendant. Aggravating considerations, the defendant's actions are considered contrary to the government's program on eradicating corruption.

"The defendant did not admit his actions and did not want to be honest", he said.

Meanwhile, the mitigating factor is that the defendant has never been convicted and behaved politely during the trial period.

"To try, impose a sentence of 5 years and 6 months in prison plus a fine of IDR 100 million. If it is not paid, it will be replaced with 2 months in prison", he said.

In addition, the defendant was also given an additional sentence in the form of paying replacement money of IDR 361 million. If within one month after the decision has permanent legal force, the replacement money is not paid, then the property is confiscated.

"If the confiscation is not sufficient, then it will be replaced with imprisonment for 3 months", he said.

Upon the judge's decision, the defendant Budi immediately expressed his thoughts. "I think the decision is very heavy, so I thought about it first, Your Honor", he said via teleconference.

Meanwhile, the Public Prosecutor (JPU) from the KPK also expressed his thoughts on the decision. The Public Prosecutor also previously demanded the defendant the same sentence, namely 5 years and 6 months in prison.

"We are thinking about it, Your Honor", said the prosecutor.

It is known, that this case stems from the procurement and installation of a six-roll mill at the PTPN XI Djatiroto Sugar Factory for the 2015-2016 period with a contract value of IDR 79 billion.

The auction, which has been arranged with a private party, namely PT Wahyu Daya Mandiri, is also suspected of causing state losses of up to IDR 15 billion. In this case, apart from detaining the former Production Director of PT Perkebunan Nusantara (PTPN) XI Budi Adi Prabowo, the KPK also detained the Director of PT Wahyu Daya Mandiri, Arif Hendrawan.
