Corruption Prisoner Dies, Komnas HAM Is Asked To Intervene

JAKARTA - Legal Advisor to Erdi Sutanto's Heirs said that his party requested The National Commission on Human Rights (Komnas HAM) assistance to fight for the right to health of detainees after the death of the defendant in the BUMN corruption case PT DP Kodja Bahari Iman Saptadi.

“I reported it to Komnas HAM because it was Komnas HAM that studied. Can this court process ignore health conditions? I hope this will be a lesson," Erdi told reporters at the Komnas HAM Office, Central Jakarta, Friday, May 13.

He explained that his client, the late Iman Saptadi, had received treatment at Adhyaksa Hospital, South Jakarta for three weeks.

Iman Saptadi also briefly became a city prisoner after his treatment at Adhyaksa Hospital, before finally getting a summons to languish in a detention house.

"From dr. Siswo (from Adhyaksa Hospital) said Iman was able to carry out daily activities but had to take medication regularly," he said.

However, Erdi said, Iman's condition continued to decline while he was in the South Jakarta Prosecutor's Office Detention Center.

He said that his party in March 2020 sent a request for a suspension of detention to the panel of judges to change Iman's status from a prisoner of the South Jakarta Prosecutor's Office Detention Center to a city prisoner.

Finally, on April 2, 2020, the Attorney General's Office contacted Iman's family to pick up Iman at the detention center and bring him home.

About two weeks after Iman became a city prisoner, Iman died.

"Our assumption is that Iman was sent home because his condition was already worrying," said Erdi.

However, based on the Letter of the Head of the Supervisory Board of the Supreme Court of the Republic of Indonesia Number 662/BP/DLG/7/2021, the Panel of Judges granted the request from Iman's legal adviser to make Iman a city prisoner in response to the widespread COVID-19 pandemic.

"We expect the seriousness of the judicial process in dealing with the condition of sick prisoners. We also hope that the court apologizes to the family," Erdi said.

After meeting with Komnas HAM, Erdi believed that this case would be processed properly. "We'll just have to wait," he said.
