JAKARTA - Seeing the rise of cyber incidents in Indonesia, cybersecurity expert and Chairman of the Cyber Security Research Institute (CISSReC) Pratama Persadha urged the establishment of a Personal Data Protection Agency (PDP).

According to Pratama, one of the main causes of data leakage is the absence of sanctions, both administrative sanctions and fines for companies or organizations experiencing data leakage.

"Where the penalty sanctions can only be imposed by institutions or commissions formed by the government, in this case the President," Pratama said in a written statement on Wednesday, September 18.

Pratama emphasized that the formation of this PDP supervisory agency should be formed immediately before October 17, 2024, just one day before the Personal Data Protection Law (PDP) takes effect.

According to him, the absence of the PDP institution which can impose sanctions actually makes companies or organizations experiencing data leakage as if they were ignoring cybersecurity incidents, and they did not even publish reports related to the incident.

"Even though this violates Article 46 paragraph 1 mandated in Law No. 27 of 2022 concerning Personal Data Protection, where the Law stipulates that in the event of a failure to protect Personal Data, Private Data Control must be notified in writing no later than 3 x 24 (three times twenty-four) hours to Personal and Institutional Data Subjects," he said.

Therefore, he emphasized that the establishment of the PDP Organizing Institution is an urgency that must be resolved immediately by the Government and the President, especially from 3 (three) perspectives.

The first perspective is cyber security perspectives, national security perspectives, where PDP Organizing Institutions will be able to provide critical infrastructure protection in Indonesia, as well as a national resilience perspective, where PDP Organizing Institutions will be able to maintain state sovereignty and economic sovereignty.

"A competent and effective leadership will be able to increase public confidence in the country's ability to protect citizens and infrastructure from cyber threats," said Pratama.
