JAKARTA SpaceX decided to sue the American National Labor Relations Council (NLRB) on Thursday, January 4. They sued NLRB after being accused of illegal dismissal.

On Wednesday, January 3, NLRB said that SpaceX had revoked the rights of its employees by firing them unfairly. For the dismissal, NLRB said that SpaceX had violated federal labor laws.

This allegation is based on the company's actions against five employees who criticized Elon Musk's behavior on social media. The company is known to have integrated and underestimated all employees who criticized Musk before firing them.

SpaceX denies the NLRB allegation. The commercial space company said that the five employees they fired did not send open letters to the executives, but to thousands of employees during working hours.

The distribution of letters through this internal communication platform was deliberately carried out to ask for the support of thousands of employees who received the letter. However, this distributed letter has caused unwanted disturbances.

The Open Letter causes significant disruption to SpaceX employees across the country. SpaceX dismissed several employees involved in the Open Letter for violating various company policies, SpaceX said in a lawsuit document.

Apart from defending himself, SpaceX accused NLRB of violating constitutional rules regarding power separation. The reason is, the NLRB had threatened SpaceX to bring the matter forward to the administrative legal judge (ALJ).

SpaceX said that the NLRB had violated SpaceX's constitutional right to be tried by the jury. Therefore, they asked the court to assume that the actions of the NLRB and ALJ were unconstitutional and contained the trial process planned by ALJ on March 5.

For this reason, SpaceX is entitled to declarative assistance and interlocutory decisions to ensure that SpaceX is not subject to unlawful processes before unstructured institutions constitutionally," SpaceX explained.
