JAKARTA - The Corruption Eradication Commission (KPK) appreciates the steps taken by President Joko Widodo (Jokowi) to ratify Government Regulation Number 105 of 2021 which regulates the auction of confiscated objects by the Corruption Eradication Commission.

Acting KPK Spokesperson for Enforcement Affairs Ali Fikri said the new regulation was like a breath of fresh air in an effort to handle corruption cases handled by his institution. Not only that, the new regulation also allows the KPK to auction off all confiscated items from corruption crimes even though they are still in the investigation stage.

"The PP allows the KPK to be able to conduct an auction of confiscated objects from the investigation stage," Ali told reporters, Monday, October 25.

He also said that this PP would also optimize efforts to recover state losses. The reason is that the KPK can minimize the cost of maintaining assets confiscated from corruptors.

"This minimizes maintenance costs and anticipates the depreciation of confiscated assets. So that efforts to recover state financial losses can be carried out optimally," said Ali.

With this breakthrough policy, the KPK believes that the corruption eradication process will be more effective and efficient. "And still be able to provide an optimal outcome as a contribution to the coffers of state revenue," he said.

PP 105 of 2021 was signed by President Jokowi on October 12, 2021 and promulgated by Menkumham Yasonna Laoly. The regulation states that the auction of confiscated objects can be carried out at the stage of investigation, prosecution, or the case has been transferred to the court. This is regulated in Article 3 Chapter II.

Meanwhile, Article 4 states that the criteria for confiscated objects that can be auctioned are goods that are quickly damaged, dangerous or the storage costs will be high. "In the event that the confiscated object as referred to in paragraph 1 (perishable) is an object that is prohibited or prohibited from being circulated/traded based on the laws and regulations, it is excluded from being auctioned," the regulation reads.

Regarding the request or approval in Article 5, it is mentioned that it is carried out with the approval of the suspect and his proxy which is sought by the investigator or public prosecutor whose request for approval is through electronic or non-electronic media.

"Based on the request for approval as referred to in paragraph (2), the suspect or his proxies shall provide a response no later than 3 days from the receipt of the request for approval," the article was quoted as saying.
