The Case Of A J&T Ambonese Employee Allegedly Intimidated By The Company Until She Resigned Tried At PHI

AMBON - The Industrial Relations Court (PHI) at the Ambon District Court has tried the case of Nira Rosanti Asyura, an employee of the Ambon Regional J&T freight forwarder who resigned after allegedly being intimidated by the company's management.

The Chief Justice of the PHI Court, Lucky Rombot Kalalo, held a trial with the agenda of hearing witness statements from the company. The company said the problem with its female employees had been resolved in a bipartite and tripartite manner by involving the Ambon City Manpower and Transmigration Office.

Meanwhile, Ahmad Soulisa and Haldi Asel from LBH Insan Cipta who accompanied Nira Rosanti explained that their client was intimidated by the company management on September 28, 2020.

The intimidation was carried out by sending a short message to the female employee offering three options, including being transferred to Saumlaki, Tanimbar Islands Regency, paying compensation, or being reported to the police.

If Nira Rosanti does not make a statement of resignation, then she must choose the three options offered by the company's management.

"At that time our client was undergoing hospitalization at the Indonesian Air Force Hospital in Laha Village, Teluk Ambon District, but the company argued that he was often sick and rarely came to work", he said, quoted by Antara, Friday, October 8.

Finally, Rosanti was asked to make a statement of resignation and sign it, and the company only paid overtime.

"For severance pay and wages for the settlement process from the bipartite, tripartite, to the trial at the Ambon District Court, our client demands a payment of IDR 41 million", said Ahmad.

This claim was brought to the PHI judge at the Ambon District Court to ask the court to decide on the work dispute case that was experienced by Nira Rosanti.
