Call Formula E Violating Rules From The Beginning, PDIP: BPK Negligent!

JAKARTA - Member of the PDIP faction of the DKI DPRD, Gilbert Simanjuntak, is surprised why the Supreme Audit Agency (BPK) did not reveal any irregularities in Formula E's budgeting since it was planned for 2019.

Because, Gilbert considers that the Formula E budget was suddenly included in the preparation of the Revised Regional Budget (APBD-P) for the 2019 budget year into a regional regulation.

In fact, in Law Number 17 2003 concerning State Finance, Article 17 paragraph (2) states that the preparation of the APBD is based on the work plan of regional apparatus (RKPD). However, in fact, the plan for the Formula E event departed from Anies' desire suddenly after the 2019 APBD was ratified.

BPK did mention the Formula E budget issue in the 2020 DKI Provincial Government financial audit report. However, BPK only recommended DKI revise the Formula E feasibility study and asked DKI to look for sponsors to reduce the APBD burden.

"This budget is a violation of rules and abuse of authority because it does not come from the RKPD and RPJMD and is entered through the APBD-P. This is the negligence of the BPK because it was not mentioned in the BPK report, even though it has clearly violated the rules," Gilbert told reporters, Monday, September 20.

Furthermore, Gilbert also questioned why BPK did not mention the obligation of DKI Jakarta Governor Anies Baswedan to pay the commitment fee for Formula E for 5 years of implementation.

In fact, Government Regulation (PP) Number 12 of 2019 concerning Regional Financial Management, budgeting activities that last for more than a year cannot pass the term of office. Meanwhile, Anies' tenure will end in 2022.

"Obviously this violates the PP and the next governor is holding hostage. In the BPK examination, this should be disclosed, unless the BPK does not understand the rules," said Gilbert.

In addition, Gilbert also questioned why the Ministry of Home Affairs (Kemendagri) approved the 2019 APBD-P which included the components of Formula E activities. Given that the ratification of the regional regulation, before being ratified, it must be approved by the Ministry of Home Affairs.

"In reality, Formula E does not meet these requirements and is also not included in regional strategic activities. When the 2019 APBD-P Perda was submitted to the Ministry of Home Affairs, this should have been very disturbing and the Ministry of Home Affairs canceled it," he continued.
